A. 
The volunteer fire company shall be organized pursuant to Code of Virginia, § 27-9, and shall consist of not less than 20 active firefighters.
B. 
Members of the volunteer fire company shall be active, able-bodied persons of not less than 18 and not more than 60 years of age, and shall not be members of the Police Department.
C. 
The volunteer fire company shall make and adopt bylaws not in conflict with the laws of the state, the ordinances of the City, and the bylaws and regulations of the Fire Department. New members of the company shall be elected by vote of the company according to its bylaws, a copy of which with all amendments shall be filed with the City Council. The chief and career firefighters shall not be members of the volunteer fire company.
D. 
All monies appropriated or donated to the volunteer fire company shall immediately be paid into the treasury of the company.
E. 
All personal property other than money donated to the volunteer fire company shall become and be the property of the City for the exclusive use of the Fire Department.
F. 
The chief shall appoint, following the December meeting of the company, the following officers from the members of the volunteer fire company: a volunteer chief, a captain, a first lieutenant, and two second lieutenants. These appointed officers shall serve for a period of one year commencing January 1 following their appointment and shall not hold the same office for more than two consecutive years. The chief, in the event of vacancy in any of such offices, taking into consideration the recommendations of the membership of the volunteer fire company, shall have the power to fill such vacancy by appointment.
G. 
It shall be the duty of the officers of the volunteer fire company to assist the officers of the career fire company at the scene of fires and any other Fire Department related functions.
H. 
At no time during any Fire Department related function shall the authority of the officers of the volunteer fire company supersede that of the officers of the career fire company or their representatives.

A. 
Pursuant to the authority of the Code of Virginia § 40.1-79.1, juveniles 16 years of age or older, with written approval of a parent or legal guardian, may become a member of the volunteer fire company. Such minors are hereby authorized (i) to seek certification under National Fire Protection Association 1001, level one, firefighter standards, as administered by the department of fire programs, and (ii) to work with or participate in activities of the volunteer fire company, within the limitations set forth herein, provided the minor has attained certification under National Fire Protection Association 1001, level one, firefighter standards, as administered by the department of fire programs.
B. 
The certification and written parental or guardian approval shall remain on file in the office of the volunteer fire company for each minor who is enrolled pursuant to this section.
C. 
Any trainer or instructor of such persons mentioned in Subsection A of this section or any member of a paid or volunteer fire company who supervises any such person at the scene of any emergency shall be exempt from the provisions of the Code of Virginia § 40.1-103, which pertains to child safety, provided that the provisions of the Code of Virginia § 40.1-100, have not been violated, and provided the volunteer fire company has purchased insurance which provides coverage for injuries to or the death of such minor in the performance of activities under this section.
D. 
The volunteer fire company shall not knowingly permit any minor trainee or volunteer, with or without certification, to enter a burning structure or a structure which contains burning materials, except in a controlled training exercise supervised by a career or volunteer certified Virginia Department of Fire Program instructor.

Financial relief shall be extended by the City to volunteer firefighters who are killed or injured while engaged in fighting fire or while responding to an alarm or returning from the scene of a fire.

The Clerk of the Circuit Court of the City shall keep a complete and accurate record of all names certified as volunteer firefighters in accordance with the definition in § 42-31 in a book provided by the City Manager on behalf of the City Council. Names shall be added to or stricken from such record upon the certificate of the secretary of the volunteer fire company that such action has been decided on by his organization in due form.
