The Fire Chief shall be compensated at the rate of nine hundred
dollars ($900.00) per month. The Assistant Fire Chief shall be compensated
at the rate of three hundred dollars ($300.00) per month. In addition,
to said compensation, the Fire Chief and Assistant Fire Chief shall
receive the standard rate of fifteen dollars ($15.00) per call attended.

The Fire Chief shall have full power, control and command over
all persons at fires, excepting regularly constituted Police Officers;
shall station and supervise fire apparatus and shall see to it that
all persons belonging to the Fire Department perform the duties required
of them; and it shall be the duty of the Fire Chief at all fires to
direct all such measures as shall be deemed advisable for the extinguishment
and control of said fire, and for the safety of persons and property
in the vicinity thereof. The Fire Chief shall have police power, including
the authority to make arrest for the violation of any of the provisions
of this Chapter. At the scene of any fire, the Fire Chief, or in his/her
absence the assistant who shall be in command at the time, may delegate
such power to such members of the Fire Department, or such other persons
present as may be specifically deputized by him/her for that purpose.

It shall be the duty of the Fire Chief to adopt, in his/her
discretion, all prudent measures for the prevention of fires, and
for this purpose he/she or his/her assistants may, whenever he/she
has reason to believe that the safety of the property or life demands
it, and as he/she may deem proper, enter any building, yard, or premises
in the City and examine the fireplaces, hearths, chimneys, stoves,
pipes, boilers, furnaces, heating pipes, lighting appliances or other
apparatus liable to cause fire; also places where gunpowder, ashes,
straw, hay, shavings, oil, or other combustible material may be deposited,
kept or stored, and give such directions for the alteration, change,
removal or better care of the same as he/she may deem proper, and
such directions shall be obeyed and complied with by the persons so
directed, and at their expense.

The Fire Chief shall also adopt in his/her discretion such system
of examination as he/she may deem practicable of the following classes
of buildings already erected or that may hereafter be erected within
the City as shall render the Fire Department familiar at all times
with the manner of construction and internal arrangement of such buildings,
that their modes of ingress and egress may be facilitated in case
of fire, to-wit: school buildings, public halls and theaters, manufacturing
establishments, hotel, business houses, and warehouses.

Any person at or near a fire who shall conduct himself/herself
in a disorderly manner or neglect or refuse to obey promptly any proper
order of the Fire Chief or his/her assistants, or shall resist, obstruct,
hinder or abuse any officer of the Fire Department, fire guard or
any fireman, in the proper discharge of his/her duties, shall forthwith
be arrested without warrant by any of the aforesaid officers. The
power to make such arrest is hereby invested in the above named officers.

In responding to any alarm, fire apparatus shall have the right-of-way
over all other vehicles; and upon an alarm of fire, other traffic
shall be required to stop and all vehicles upon the streets shall
be required to pull to the closest curbing and remain still until
all fire apparatus has passed. Any person or persons obstructing the
streets by moving houses, digging ditches, etc., shall be required
to notify the Fire Department by phone or otherwise of location of
same not later than the sundown of each day that said street or streets
are kept blocked, and in future all persons granted permits to in
any way obstruct a street shall be notified of the foregoing requirements
by the person issuing the permit.

A.
Should
the Fire Department answer a call from outside the City limits, the
charge for making such call outside the City (regardless of the success
or failure of the mission) shall be a three hundred fifty dollar ($350.00)
minimum, not to exceed five hundred dollars ($500.00) per call.
B.
Firemen
responding to calls outside the City limits shall be compensated at
the rate of fifteen dollars ($15.00) per fireman for the first (1st)
two (2) hours of fire call service with each additional hour accruing
a charge at the rate of ten dollars ($10.00) per hour per fireman.
C.
Property
owners shall be responsible for any charges accrued for services by
the Cabool Fire Department.
