The office of City Clerk is hereby created.

The Mayor shall, with the consent and approval of a majority of the members elected to the City Council, appoint some suitable and competent person to the office of City Clerk.

No person shall be eligible to the office of City Clerk who does not possess a practicable knowledge of bookkeeping, and whenever it shall appear to the satisfaction of the City Council that the person appointed to said office does not possess such knowledge, the Council may declare the office vacant. No person shall be eligible for the office of City Clerk who is in arrears for any amount owed to the City.

If, in case of death, resignation, absence from the City, or for any other cause, a vacancy shall occur in the office of City Clerk, the Mayor shall appoint a suitable person to discharge the duties of the office until the first (1st) regular meeting of the City Council thereafter at which time the Mayor, with the consent and approval of a majority of the members elected to the City Council, shall permanently fill such vacancy by the appointment of a City Clerk.

Whenever, for any reason, the City Clerk is unable to perform the duties of his/her office, the City Council may, by resolution, appoint a temporary clerk, who shall have all the power and perform all the duties of the regular clerk and shall receive the same salary for the time he/she so acts, but in no event shall the regular and temporary clerk receive pay at the same time, nor shall the regular clerk receive any pay for the time he/she fails to perform the duties of his/her office.
The City Clerk shall, among other duties, keep the journal of the proceedings of the Council. He/she shall safely and properly keep all records and papers belonging to the City which may be entrusted to his/her care, and generally shall perform all the duties required of him/her by ordinance or orders of the Council. He/she is hereby empowered to administer official oaths, and also oaths to persons certifying to demands or claims against the City.

A. 
The City Clerk shall have the custody of and safely keep the common Seal of the City, the public records, the original rolls of ordinances and resolutions of the City Council, and such other records, documents and papers of a public nature as may be delivered into his/her custody. He/she shall affix the common Seal of the City to all public instruments and official acts of the Mayor which by law or ordinance are required to be attested, and countersign the same, and affix the common Seal to and certify any record, document, copies of papers or ordinances that may be required for evidence in any court of this State or of the United States by any individual, or that may be required for the use of any officer of the City, and shall furnish to the City Attorney any record or document in his/her office necessary to be used in any proceeding in court to which the City is a party.

The City Clerk shall prepare all certificates of election, commissions, appointments and other official documents required by ordinance to be issued, or which the Mayor in the discharge of his/her duty is required to issue, and shall countersign and affix the common Seal thereto and keep a record of all certificates of election, commissions, appointments and documents.

The City Clerk shall record all City ordinances passed, and he/she shall neatly label and file for safekeeping the original rolls of all ordinances and resolutions of the City Council and such other vouchers, papers, records and documents as may be delivered into his/her custody. He/she shall properly index all records of ordinances, resolutions and other documents required by any law or ordinance to be recorded in his/her office.

The City Clerk shall record the official bonds of all City officers and the bonds of all other persons executed to the City and placed in his/her custody.

The City Clerk shall carefully and promptly execute every official duty that may be required of him/her by virtue of State law and the ordinances of this City.
