A.
There
is hereby established the position of Cemetery Director of the City
cemetery. The Cemetery Director shall be appointed by the City Manager.
He/she shall serve at the pleasure of the City Manager. Said Cemetery
Director shall have such duties as dictated by the City Manager and
such duties as are consistent with the provisions of this Chapter.
B.
Any
person before opening or digging a grave within the City cemetery
shall first obtain a permit therefor from the Cemetery Director.

A.
There are hereby established the following prices and fees for grave
spaces at the City cemetery and services rendered by the cemetery
personnel:
1.
All grave spaces in the cemeteries shall be three hundred dollars
($300.00) per grave space.
2.
All human tissue shall be buried on a designated grave space.
No more than four (4) such burials shall be made per grave space.
There shall be a charge of thirty dollars ($30.00) per burial of human
tissue and limbs.
3.
There shall be a charge for services of three hundred dollars
($300.00) on weekdays and four hundred ($400.00) on weekends for all
burial in graves.
4.
There shall be a charge of one hundred dollars ($100.00) for
installation of government markers on graves.
5.
The opening of a grave for disinterment and reburial of a box
or vault shall be done only by a licensed funeral home under the supervision
of cemetery personnel. There shall be a charge of five hundred dollars
($500.00) for the refilling of a grave where a box or vault has been
removed.
6.
No fencing of any kind or description shall be built or placed
in or around any lot or lots in the cemeteries, except that fencing,
concrete markers and upright monuments may be permitted, upon approval
by the Cemetery Director, in the southeast quarter of the Linton section,
the northeast quarter of the Linton section, Block 4 of Old City and
in Felkins Annex to Old Ulrey. All copings on or around the lot shall
be flush with the ground.
7.
There shall be a charge of one hundred fifty dollars ($150.00)
for cremation services performed during weekdays. There shall be a
charge of two hundred dollars ($200.00) for any cremation performed
on weekends.
8.
The Mayor may, at the request of a licensed funeral home, waive
the payment of prices and fees for grave spaces at the City cemetery
and services rendered by cemetery personnel with regard to burial
of unclaimed bodies. Funeral homes requesting such a waiver must complete
forms available from the office of the City Clerk indicating what
steps have been taken to attempt to locate relatives of the deceased.
Upon waiver of said fees, the City Clerk shall deliver to the cemetery
sexton a permit indicating such waiver. After a waiver has been obtained,
the funeral home must give the City Cemetery Department at least five
(5) days' notice of the proposed date for burial.

All monies received from the sale of cemetery lots or other
matters connected with the cemetery shall be paid into the City Treasury
and the City Treasurer shall receipt for the same.

No deed shall be executed and delivered and no interest shall
be in any manner conveyed in any cemetery lot or part thereof, unless
the sale of said lot or lots is immediately reported to the Cemetery
Director and the price of said lot paid in full by the purchaser thereof.

It shall be the duty of the Cemetery Director to execute and
deliver sufficient deeds of conveyance of the lots in the City cemetery
to any person who may purchase the same at the price or sum determined
by this Chapter.

The Mayor may assign a place of burial to any poor person unable
to pay for the same when necessity demands it, free of charge, in
certain blocks set aside for that purpose.

A.
The
Cemetery Director shall have and keep at all times a plat showing
each and every lot in the City cemetery showing what lots are sold
and to whom and what lots are unsold. It shall be the duty of the
Cemetery Director to keep said plat up-to-date at all times.
B.
The
City Clerk shall have a plat similar to that provided for the Cemetery
Director, which plat shall be, by the City Clerk, currently kept and
marked according to the sale of lots as they are reported to him/her
in order that said plat shall at all times show the person or persons
to whom said lots have been sold.

In addition to other requirements imposed by this Chapter and
except as stated otherwise, all bodies buried in the City and Woodlawn
Cemeteries, shall be placed in a steel or concrete outside container.
This requirement shall not apply to graves in the public sections
of the cemetery set aside for paupers and unclaimed bodies. This requirement
shall also not apply to graves for newborn or stillborn infants, provided
that such body is placed in a non-wooden box or vault.

Every person who shall dig any grave without the consent or
authority of the Cemetery Director shall be deemed guilty of a misdemeanor.

All graves shall be dug sufficiently deep so that the top of
the coffin or box shall be at least two and one-half (2½) feet
below the surface of the ground.

The use of all lots in the City cemeteries and their subdivisions
is hereby restricted to the burial of the human dead and the said
lots shall not be used for any other purpose.

There shall be no burials on Sunday or on established legal
holidays in the City cemeteries.

After reasonable notice to the owner thereof or other appropriate
person, the Cemetery Director may remove such fences as the Cemetery
Director determines to be in a deteriorated state, not maintained
or presenting an unreasonable obstruction to cemetery maintenance.
