No person shall discharge or shoot fireworks of any kind in the City except as permitted by the provisions of this Article.

The discharge or shooting of fireworks within the City shall be permitted by civic organizations when the civic organizations have been granted permission to do so by a majority vote of the City Council and inspection and approval by the Missouri State Fire Marshal's office and the Poplar Bluff Fire Department has been obtained. This requirement encompasses inside and outside fireworks display events.

Whenever any civic organization is granted permission to discharge or shoot fireworks within the City, the organization shall shoot the fireworks only under the supervision of the Chief of the Fire Department and the Chief of Police.

A. 
The owner or operator of any temporary fireworks stand for the retail sales of fireworks within the City limits of the City of Poplar Bluff shall obtain a temporary permit from the City of Poplar Bluff for the location of each stand. Such permit shall be obtained prior to the erection of any said temporary stand. The fee for said permit shall be as is directed from time to time by the City Council of the City of Poplar Bluff, Missouri. Each of said temporary stands shall be inspected and approved by the City of Poplar Bluff prior to the operation of said temporary stand.
B. 
No temporary fireworks stand shall be permitted within any zoning district other than a "C-2" commercial district or a less restrictive zoning district than "C-2" commercial district.
C. 
The owner and the operator of each temporary fireworks stand shall be responsible for compliance with all applicable City ordinances and regulations relative to the operation of temporary fireworks stands for the retail sale of fireworks.
D. 
In addition to the general penalty provisions of this Code of Ordinances for violation of these ordinances, failure to comply with the provisions of this Article and any regulations issued by the City of Poplar Bluff shall result in the immediate suspension of all permits and licenses issued to the owner and operator of said temporary fireworks stands who shall fail to comply.

A. 
The following regulations shall apply to all temporary fireworks stands selling fireworks at retail:
1. 
Valid permit and display of permit; State Fire Marshal's Office: Permit for the Sale of Fireworks.
2. 
Fire extinguishers.
a. 
Minimum of two (2) fire extinguishers. At least one (1) must be pressurized water type.
b. 
Location of less than two hundred (200) square feet; minimum of one (1) (two (2) a minimum).
c. 
Maximum travel distance to an extinguisher: Thirty-five (35) feet.
d. 
All in accessible locations.
e. 
Employee trained in extinguisher operations.
3. 
Site requirements.
a. 
Certificate or other evidence verifying tent fabric is fire retardant heated.
b. 
No hay, straw or shavings unless flame retardant treated.
c. 
Thirty (30) foot area around site clear of dry grass, dry brush and combustible debris.
d. 
Fireworks not displayed behind glass in direct sunlight.
e. 
Fireworks out of public reach when attendant not on duty.
f. 
No parking within ten (10) feet of sales location.
g. 
No storage trailer within ten (1) feet of sales location.
h. 
Twenty (20) feet from other building, other sales locations, cooking equipment, and generators.
i. 
No temporary fireworks stand in a non-permanent structure shall be located within one hundred (100) feet of any filling station or storage facility for inflammable materials.
4. 
No smoking signs.
a. 
At least one (1) sign with four (4) inch letters at each entrance: "Fireworks No Smoking".
b. 
No smoking within twenty-five (25) feet of sales area.
5. 
Means of egress.
a. 
Minimum of two (2) remote means of egress free of obstruction.
b. 
Minimum clear aisle width not less than forty-eight (48) inches.
c. 
Tent exit opening not less than forty-four (44) inches in clear width.
d. 
All fireworks not within two (2) feet of any entrance or exit.
6. 
Emergency lighting and exit sign.
a. 
Exit signs to be self luminous or illuminated. (Required if open for business after dark.)
b. 
Emergency lighting required in sales area of eight hundred (800) square feet or greater (not required if not open after dark).
7. 
Electrical equipment.
a. 
All wires from electric meter to fireworks sales area shall be a minimum of ten (10) feet above ground or shall be buried in conduit. Electrical system and equipment isolated from the public.
b. 
All electrical wiring and equipment U.I. approved, installed and maintained to prevent electrical hazards.
c. 
Branch circuits protected by G.F.C.I. (If susceptible to water exposure.)
d. 
Electrical service to said temporary fireworks stands shall be by properly installed "ground fault" system.
8. 
Prohibited activity/items.
a. 
Person under sixteen (16) years of age prohibited from selling or working unless under the supervision of another at least eighteen (18) years of age.
b. 
Electronic pest control devices prohibited inside sales location.
c. 
Alcoholic beverages prohibited.
d. 
Proximate and display fireworks not sold with 1.4G fireworks.

The Fire, Police and Inspections Departments are hereby authorized to issue such additional regulations as they deem necessary for the protection of the citizens of Poplar Bluff and the patrons of said temporary fireworks stands and as are consistent with provisions of the regulations contained herein.
