As used in this Article, the following term shall have this
prescribed meaning:
A family home occupied by the day care provider in which
family-like care is given to five (5) to ten (10) children not related
to the day care provider for any part of the twenty-four (24) hour
day. The maximum number of children under the age of two (2) shall
be three (3).

A.
Conformation With Codes Required. The building and premises
shall conform to meet local residential, health, sanitation and fire
codes.
B.
Indoor Space.
1.
The area designated for child care shall provide a minimum of thirty-five
(35) square feet of usable floor space per child. Floor space occupied
by permanent built-in cabinets or shelves or large pieces of furniture
or equipment not intended for children's use may not be considered
as usable floor space. Kitchen and bathrooms shall not be counted.
2.
The physical plant shall be safe and suitable for the care of children.
a.
Open windows shall be securely screened. Safeguards to prevent children
from falling from window openings shall be provided.
b.
Fireplaces, open-faced heaters, hot radiators or floor furnaces shall
be protected by screens or as recommended by the State Fire Marshal.
c.
Walls and floors shall be finished so as to be free from splinters
and cracks and easily cleaned. Lead-free paint shall be used for all
painted surfaces.
d.
Clear glass doors shall be plainly marked at varying heights to avoid
accidental impact.
e.
All flammable liquids, matches, cleaning supplies, poisonous materials,
guns, firearms or other hazardous items shall be stored so as to be
inaccessible to the children.
f.
The home shall be reasonably clean and tidy at all times, free from
dirt and any evidence of vermin, flies and rodent infestation.
g.
There shall be a telephone in working order.
3.
The home or apartment shall be dry, well heated, well ventilated
and well lighted. Temperature of the room shall be no less than sixty-eight
degrees Fahrenheit (68°F) (twenty degrees centigrade (20°C)).
4.
There shall be storage space accessible to children for play materials
and equipment.
5.
Provisions for space for a child's clothing and other personal belongings
shall be made.
6.
Bathroom facilities.
a.
There shall be a flush toilet and running water handwashing facilities
or facility.
b.
Toilet and handwashing facilities shall be convenient and easily
available for the children's use and be in working order. There shall
be steps provided so that the children may reach the sink or a basin
must be installed at a height the children can reach.
c.
Individual towels and washcloths or soft, absorbent paper towels
shall be provided for the children.
d.
Potty chairs shall be located in the bathrooms and shall be emptied
and rinsed after each use. They must be thoroughly cleaned and disinfected
daily.
7.
Kitchen.
a.
The kitchen shall be equipped with a stove, sink, hot and cold running
water, refrigeration and storage space for food, dishes and cooking
utensils.
b.
Kitchens shall not be used for children's play activities unless
they are adult supervised and part of the learning program.
c.
Kitchens shall not be used for napping.
8.
Basements. A basement is any lower level of a home
without a direct exit outside at ground level.
a.
No basement shall be used for complete child care.
b.
If a basement area of a building is used for any of the children's
activities, it shall be approved by a fire inspector, shall have two
(2) exits, be warm, dry, well ventilated and well lighted.
c.
Children shall have no access from the approved basement play area
or other basement areas.
C.
Outdoor Play Space.
1.
There shall be outdoor play area conveniently located to permit children
to reach it without hazard.
2.
There shall be a minimum of one thousand (1,000) square feet of outdoor
play area in the rear yard. The area shall be fenced. The fence shall
have a height of at least four (4) feet from the ground level and
must have a locking gate with a latch at least four (4) feet from
ground level.
3.
The surface of the play area shall have good drainage, be safe, suitable
for the children's activities, free of hazards such as broken glass
and other debris and it shall be well maintained.
4.
The area under climbing equipment, swings, slides and other equipment
from which children might fall shall be resilient material such as
grass, sand, tanbark, rubber matting and the like.
5.
The outdoor play area must be hazard free and keep children away
from traffic, water and other dangers. There shall always be an adult
supervisor outside with the children.
6.
Swimming and/or wading pools shall be constructed, maintained and
used in such a manner as to safeguard the lives and health of the
children.
a.
Swimming pools and/or other areas such as ponds, lakes or rivers
shall be fenced to prevent accidental or chance access by children.
Wading pools that are left filled with water when not in use shall
also be protected in some way.
b.
The water in the pool or other water areas shall be treated, cleaned
and/or maintained in accordance with health practices and regulations
as determined by the local or State health authority.
D.
Off-Street Parking. There shall be a minimum of four (4)
off-street parking spaces provided.
