A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Poplar Bluff, Missouri, being marked and designated as the International Building Code, 2018 Edition, including Appendix Chapters E, F, G, H and I, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Poplar Bluff, in the State of Missouri for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City Clerk are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.015 of this Article.

No building permit or other permit shall be issued to any contractor or subcontractor unless such contractor or subcontractor shall first pay the license tax provided by the occupational license tax schedule.

A. 
Before beginning the stripping, excavation, grading or removing of soil for sale or other purposes with regard to residential subdivision of twenty (20) lots or five (5) acres and all commercial and industrial projects, the owner, lessee, agent, builder or architect shall obtain an excavation permit thereof from the Building Inspector's office. Prior to the issuance of an excavation permit by the Building Inspector's office, a grading plan shall be submitted to the City Planner for approval. The fee for said excavation permit shall be as follows:
1. 
Commercial and industrial under one (1) acre: $10.00.
2. 
Commercial and industrial one (1) to five (5) acres: $50.00.
3. 
Commercial and industrial more than five (5) acres: $75.00.
4. 
Residential, five (5) acres or more or twenty (20) lots: $75.00.
B. 
Before beginning the erection, construction, or alteration of any building or structure within the City, the owner, lessee, agent, builder, or architect shall obtain a building permit therefor and shall pay a fee therefor in accordance with the following:

1. 
Building Permits Application Procedures.
a. 
Prior to the residential erection, construction, remodel or reconstruction of any residence or structure or any structural alteration of an existing residence or structure within the City of Poplar Bluff, Missouri, an application for a building permit shall be submitted to the Planning Department.
b. 
Commercial applications must be accompanied by three (3) complete sets of blueprints and one (1) set of building specifications all of which have been signed, sealed and dated by a professional architect or engineer, registered in the State of Missouri. Within fifteen (15) days of the submission of a preapplication for building permit with all applicable accompanying documentation, the Building Inspector shall calculate and determine a building inspection fee, plumbing inspection fee, mechanical inspection fee and electrical inspection fee in accordance with the provisions of this Section. A building permit may be issued, provided the applicant has satisfied all conditions and requirements of the building and zoning regulations of the City of Poplar Bluff, Missouri, and the applicant's payment of all inspection fees and building permit fees.
2. 
Permit fees may be calculated utilizing the following method listed below:
a. 
The following formula will be used to determine the permit fee for new commercial buildings within the City of Poplar Bluff. Using the total cost of the project and applying the multiplier of .0037 determines the permit fee. If the project has a contract bid that has been accepted, that will be the total cost. If no contract, a total cost will be supplied by permit applicant and this will be compared to the total cost determined by using the International Building Code (IBC) formula for determining total construction cost. If the two (2) figures are close, the one provided by the applicant will be used. If the figures are some distance apart, the Building Department will determine whether to average the two (2) or use the IBC calculated value.

The IBC formula for determining construction value is:
Gross Area x Gross Area Multiplier x Type of Construction Factor x Permit Fee Modifier
(2) 
Gross area is the actual square footage of the structure.
(3) 
Gross area multiplier is the factor applied to allow for local differences in building costs compared to the national building cost averages. This factor for new commercial buildings shall be 0.72 and for new residential facilities shall be 0.50.
(4) 
Cost per square foot is the average cost of construction per square foot established semiannually by the International Building Code Council, furnished by the International Code Council Building Valuation Data, a copy of which is kept on file by the City Clerk.
(5) 
Permit fee modifier is the figure established by the Building Official which reflects the City's expenses in providing building inspection services. The permit fee modifier is based on the expenses of the Planning Department established by the City Council from time to time. This figure shall be .0037.
b. 
For the alteration of any existing commercial or residential structure, the permit fee shall be calculated as four dollars ($4.00) per one thousand dollars ($1,000.00) of estimated cost as provided by the permit applicant.
c. 
In addition, each construction discipline (mechanical, electric, and plumbing) shall require a separate permit/inspection fee. These fees are outlined in Chapters 520, 525, and 530 of the City Codes of the City of Poplar Bluff.
d. 
In special instances, the City of Poplar Bluff may consider proposals to reduce or waive building permit fees, the purpose of this action being to encourage the creation of new private sector jobs, to increase property tax valuation, to promote the retention and expansion of existing industry and to assist in the attraction of new businesses to Poplar Bluff. Specifically, the employment of this incentive shall be limited to businesses classified under the North American Industry Classification System (NAICS) manual as Sector 31-33 Manufacturing; Section 51, Subsector 514, Information Services and Data Processing Services; and Section 54 Professional, Scientific, and Technical Services. Warehouse and distribution facilities will not be eligible for this incentive unless they are ancillary or accessory to an eligible business located within the City limits of Poplar Bluff.
Any person who shall violate a provision of the code adopted in this Article or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan of or directive of the Code Official, or of a permit or certificate issued under the provision of this code, shall be guilty of an ordinance violation, punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
