For the purposes of this Chapter, the following words and phrases shall have the meanings respectively ascribed to them:
ADMINISTRATIVE AUTHORITY
The Building Inspector of the City of Poplar Bluff or his/her authorized representative.
BOARD
The HVACR Board created within this Chapter.
BTUH
British Thermal Unit per hour of heat.
BUILDING INSPECTOR
Any person who is appointed by the City Manager to inspect HVACR work and/or other construction work within the jurisdiction of the administrative authority to determine if the HVACR work meets the requirements of the code.
HEATING AND AIR CONDITIONING
The process of treating air to control temperature, humidity, cleanliness, ventilation or circulation to meet human comfort requirements.
HORSEPOWER
The equivalent to seven hundred forty-six (746) watts.
HVACR
Heating, ventilation, air conditioning and refrigeration (HVACR) means the design, installation, construction, maintenance, service, repair, alteration or modification of a product or of equipment in heating and air conditioning, refrigeration, ventilation or process cooling or heating systems.
HVACR MAINTENANCE WORK
The repair, modification, service and all other work required for the normal continued performance of an HVACR system. This term does not include the installation or total replacement of a system.
LICENSEE
The holder of a license issued pursuant to this Chapter.
OFFICIAL COPY
A copy of the International Mechanical Code (IMC) marked with the words "City of Poplar Bluff, Missouri Official Copy", as adopted by the City Council of the City of Poplar Bluff and appropriately amended so as to reflect any differences with the code as shown in the Poplar Bluff Mechanical Code, shall be deemed to be an official copy of the code.
ONE TON
Twelve thousand (12,000) BTUH.
REFRIGERATION
The use of mechanical or absorption equipment to control temperature or humidity, or both, in order to satisfy the intended use of a specific space other than for human comfort.
REGISTRANT
A person who:
1. 
Does not hold a Class A, Class B or Class C HVACR license;
2. 
Can only perform work for an HVACR licensee; and
3. 
Holds a current HVACR registration.
REPAIR
The reconstruction or replacement of any part of an existing HVACR system for the purpose of its maintenance.
VENTILATION
The process of supplying or removing air by natural or mechanical means to or from any space.

This Chapter shall be administered by the Building Inspector who shall take such action as may be reasonable and necessary to secure compliance with it. The City Manager shall appoint such assistants clerks and other employees as may be required to administer this Chapter and fix their compensation.

The Building Inspector with the approval of the HVACR Board is hereby empowered to promulgate such rules and regulations in accordance with the provisions of this Chapter as may be required and any rule or regulation so promulgated shall have the same force and effect as this Chapter, but no person shall be bound thereby until such rule or regulation has been posted in a conspicuous place at the main office of the Building Inspector for a period of not less than five (5) business days, except that presentation to any person of a written copy of any rule or regulation shall be in lieu of the above stated posting requirement as to that person and discussion of the change at a public HVACR Board meeting. Any deviation from the International Mechanical Code will require the approval of the HVACR Board.

The Building Inspector shall condemn any used HVACR material or equipment which is so worn, damaged, defective or constructed as to constitute a sanitary or safety hazard and such condemned material or equipment shall not be reused for HVACR purposes. Where, in the opinion of the Building Inspector, condemned material or equipment should be destroyed to prevent its reuse, he/she may order such destruction.

A. 
During the first six (6) months of implementation, there would be an opportunity for existing HVAC contractors to be licensed under a grandfathering provision without taking a test. To be licensed under those grandfathering provisions, contractors will be required to do the following:
1. 
Demonstrate the amount of activity in the HVAC trade as stated in the code for each type of license with the following pieces of evidence or other evidence deemed satisfactory by the Board:
a. 
City of Poplar Bluff merchant's license/Butler County business license.
b. 
Active licensing with the State of Arkansas, the City of Cape Girardeau, Missouri, or other regulatory agencies that test for competency.
c. 
State sales tax licenses.
2. 
Current refrigerant certification from the U.S. Environmental Protection Agency (EPA).
3. 
Must meet current bonding and insurance requirements set forth in the HVAC ordinance.
B. 
The decision of the HVAC Board regarding grandfathering may be appealed to the City Council.
