There is hereby created in and for the City an HVACR Board.

The Board shall be composed of seven (7) members as follows: A representative of the Municipal Utilities — City Cable Department, a professional engineer, two (2) Class A license holders, two (2) Class B or Class C license holders and an interested member of the general public. A Building Inspector will be an ex officio member of the Board.

The requirements for membership of said Board shall be to either live or have a business location identical to the residency requirement for employees of the City of Poplar Bluff, Missouri.

The members of the Board shall be appointed by the City Manager.

A. 
The members of the Board shall serve for terms of three (3) years each. Members shall be expected to attend all meetings of the Board and any Board member who shall fail to attend three (3) consecutive meetings without good cause shown shall be recommended for dismissal to the City Council.
B. 
The initial Board members of the Board shall have three (3) members appointed for three (3) years, three (3) members appointed for two (2) years and one (1) member appointed for one (1) year.

The Board shall meet at such times as may be necessary for proper performance of its duties.

The Building Inspector and/or the HVACR Board shall decide all disputed questions pertaining to the installation of all HVACR devices and equipment hereinafter provided for in this Chapter. Decisions shall be governed by taking into consideration the City's currently adopted Mechanical Code and the standards recognized by the HVACR Board concerning the safe and proper installation of HVACR devices and equipment.

No rule or regulation shall be promulgated without the discussion of the change at a public HVACR Board meeting. Any deviation from the International Mechanical Code will require the approval of the HVACR Board.
