It shall be unlawful for any person to sell or offer for sale farm produce on the streets or rights-of-way of Poplar Bluff, Missouri, except at the farmers marketplace created by this Chapter.

There is hereby established and created a farmers marketplace in the City of Poplar Bluff, Missouri, on the southwest corner of Moran and Maple.

The City shall own and be responsible for the overall operation of the farmers marketplace, but may contract for the operation and management of the farmers marketplace with an independent contractor approved by the City Council.

A. 
All persons using the farmers marketplace shall be subject to the following:
1. 
No person shall sell produce in or otherwise use the farmers marketplace without first obtaining a permit from the City, or from the contractor if the City has contracted for the management of the establishment.
2. 
The permit issued shall be openly displayed on the stall rented at all times.
3. 
Every user shall permit the City, its agents, or the contractor to inspect the stalls rented at any reasonable time.
4. 
Every user shall vacate the premises whenever instructed to do so by the City Manager, his/her authorized representative, or the contractor, whether the period of the permit has expired or not.
5. 
The farmers marketplace shall be used solely by persons who wish to sell produce they have raised; the marketplace shall not be used by persons offering produce or goods for resale except produce or goods produced within a one-hundred-mile radius of the City, and as approved by the City or the contractor. The contractor may permit the sale of items baked, produced or made that are not inconsistent with this provision.
6. 
No livestock shall be offered for sale at the marketplace.
7. 
No permit shall be issued to any person who violates the provisions of this Chapter.
8. 
No permit shall be issued to any person who shall create a disturbance or nuisance at the marketplace by filth or otherwise.
9. 
No permit shall be issued to any person for more than one (1) stall for the same day.

The City shall not assume responsibility for nor guarantee the goods or produce offered for sale at the farmers marketplace.
