This chapter shall be known and may be cited as the "Park and Public Property Ordinance (Ordinance No. 123, enacted October 4, 2005)."
For the purpose and within the meaning of this chapter, the following definitions shall pertain:
BOARD
The Board of Supervisors of the Township of Leacock, or their duly authorized representative.
PARK
Includes parks, playgrounds, recreation centers, walking trails, and all other areas owned, operated, maintained or sponsored by the Township of Leacock and devoted to active or passive recreation by the public within the Township of Leacock.
PUBLIC PROPERTY
Includes all other lands owned by the Township of Leacock and devoted to uses other than those listed in the definition of "park."
TOWNSHIP
The Township of Leacock.
A. 
All structures, equipment, and facilities owned by the Township in park and public property are to be used in an appropriate fashion for the activities for which they are designed and intended.
B. 
It shall be unlawful for any person to do any of the acts hereinafter described within the limits of any park or public property:
(1) 
To engage in any conduct which interferes with the peaceable use of park or public property by other people, including, but not limited to, the throwing of stones, sticks or hard objects in the vicinity of other people and the use of lewd, vulgar or sexually suggestive language or behavior in the presence of other people;
(2) 
To permit any owner's dog, livestock or other pet or animal under the owner's control to run at large;
(3) 
To fail to clean up any waste from his/her animal and to properly dispose of it in containers provided for the same or in the owner's trash collection receptacles;
(4) 
To hunt for, shoot at, harass, catch, or intentionally injure or kill or attempt to shoot at, harass, catch, or intentionally injure or kill, with or without dogs, any bird or animal;
(5) 
To commit any public nuisance;
(6) 
To possess, drink, or be under the influence of malt or brewed beverages, spirituous liquors or wine;
(7) 
To post or erect any bills, notices, or advertising matter of any kind without authorization from the Board, provided this shall not apply to notices placed by employees of the Township engaged in the performance of their duties;
(8) 
To sell or barter or offer for sale or barter any merchandise, article or thing whatsoever without authorization from the Board, provided this shall not apply to authorized concessionaires;
(9) 
To have any musical, theatrical, or other entertainment therein without authorization from the Board;
(10) 
To carry, have or discharge firearms, bows and arrows, air or spring rifles or slings, except in authorized areas;
(11) 
To swim, wade or bathe at any place, except in a public swimming or wading pool;
(12) 
To injure, deface or destroy any posted or permanently fixed signs or notices;
(13) 
To break, cut, deface, disturb, injure or take any flower, fruit, plant, tree, shrub, bench, building, fence, monument, or other structure, apparatus or property;
(14) 
To violate any posted rules for or misuse any picnic area, camp area, playfield, swimming pool or other recreational area;
(15) 
To gather or remove any wood, turf, grass, soil, rock, sand or gravel;
(16) 
To make or kindle fire, except in picnic stoves or fireplaces provided for that purpose;
(17) 
To engage in camping, archery and hitting of golf balls, except on such grounds or place specifically designated for such purpose;
(18) 
To smoke in areas where prohibited by sign;
(19) 
To discard tobacco and by-products in any park area or public property;
(20) 
To throw or deposit cans, bottles, broken glass, paper or rubbish of any description, except in containers provided for the same;
(21) 
To discard any dead animal or offensive matter or substance of any kind;
(22) 
To stand or park any vehicle, except in those areas designated therefor;
(23) 
To congregate in any area which will hamper the free movement of pedestrians;
(24) 
To operate unlicensed motor vehicles;
(25) 
To operate any vehicle or bicycle at any place other than roadways or special areas designed for operation of such vehicles;
(26) 
To operate snowmobiles, mini-bikes, go-carts or any device which utilizes burning fuel, explosive gas or compressed gas as a propellant, at any place, except in authorized areas;
(27) 
To wash, polish or repair any motor vehicle, except for emergency repairs;
(28) 
To abandon any vehicle within the limits of any park, public property or roads abutting said park or public property;
(29) 
To exceed a speed limit of 15 miles per hour, unless otherwise posted, on all roadways, driveways, parking lots and other areas intended for motorized vehicular traffic;
(30) 
To fail to show identification or to leave the park upon request of any official of the Township or the police;
(31) 
To conduct group activities of any kind without a permit from the Township; and
(32) 
To launch or use fireworks, rockets, explosives, sparklers, etc., without the prior permission of the Township.
All four public parks shall be closed between the hours of sunset and sunrise. No person, other than authorized supervisors, police, guards or similar personnel, shall occupy, frequent or use the parks between such hours, except when the parks are being used for special events, entertainments, athletic contests or similar affairs which have been authorized, scheduled and/or are supervised by the Township. In such cases, the closing time of the park where such event is being held shall be one-half hour after the event has ended, but no later than 12:00 midnight.
A. 
All permits issued by the Board shall be subject to park rules and regulations, and a person to whom such permits may be granted shall be bound by said rules and regulations as fully as though the same were set forth in the permits.
B. 
Any person or persons to whom such permits may be granted shall be liable for any loss, damage or injury sustained by any person for reason of negligence of the person or persons to whom said permits may be granted, their agents or employees.
C. 
It shall be unlawful for any permittee to make any alteration to a permit.
D. 
Specific portions of the rules and regulations of this chapter may be waived only upon written approval of the Board.
E. 
The Board may from time to time, by separate resolution, establish reasonable fees and deposits for the use of parks and facilities therein.
Any person who violates or permits a violation of this chapter shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $1,000, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue, and/or each violation of a provision of § 201-3, shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense.
