Whenever used in this Article, the following words, terms and phrases and their derivations shall have the following meanings:
CENTRAL COLLECTION SITE
A place designated by the City where residents may drop off recyclables for recycling with the contractor.
CITY
The City of Farmington, Missouri.
CONTRACTOR
The solid waste hauler selected by the City to collect recyclables for recycling.
CURBSIDE
A location adjacent to and no more than five (5) feet from any street.
PREMISES
All one-family, two-family and multiple-family dwellings located in the City.
RECYCLABLE MATERIAL
1. 
All tearable paper (catalogs, phone books, junk mail, cardboard, spiral notebooks, colored and coated paper, gift wrap paper, etc.).
2. 
Chipboard boxes (cereal, cake, food mix, milk and juice cartons, and gift boxes).
3. 
Cardboard.
4. 
Paperback books.
5. 
#1 clear and green plastic resin items (soda, water, and flavored beverage bottles).
6. 
#2 clear plastic resin items (milk and juice containers).
7. 
#2 colored plastic resin items (detergent, fabric softener, and colored plastic).
8. 
#3 and #7 plastic resin items (ketchup bottles, syrup bottles, narrow neck containers, shampoo bottles, plastic cosmetic containers, etc.).
9. 
#4 and #5 plastic resin containers (margarine tubs, frozen dessert cups, etc.).
10. 
Six (6) and twelve (12) pack rings.
11. 
Steel and aluminum cans, aluminum trays and foil.
12. 
Clean plastic buckets up to five (5) gallon size.
RECYCLABLES CONTAINER
A labeled, sturdy container furnished by the contractor for the storage of recyclables.
RECYCLING
The process of remanufacturing recyclables into other products or refurbishing them for reuse.
RECYCLING CENTER
The recycling center is owned and operated by the City of Farmington, Missouri and shall include the entire tract of real estate upon which the recycling center building is located and the public roads and alleyways adjoining said tract of real estate.
RESIDENT
Every person who is an owner or occupant of a dwelling.

A. 
Every resident of premises shall, upon their option, separate the recyclables from their respective premises from all other refuse, garbage, rubbish and waste matter and shall store the recyclables in a recyclables container furnished by the contractor. Recyclables containers shall remain the property of the contractor and shall be returned when residents relocate.
B. 
Paper recyclables shall be bundled separately; aluminum, glass and plastic recyclables may by placed together in the recyclables container.
C. 
Recyclables containers for storage of recyclables shall be kept in the same location as is designated for refuse containers; however, residents of dwellings, not earlier than twelve (12) hours prior to the day for scheduled collection of recyclables from their respective dwellings, shall place the recyclables containers at curbside adjacent to the dwelling or garage accessory thereto and visible from the street in front of the dwelling. After the scheduled collection, the containers for recyclables and any recyclables not collected shall be returned by the resident of the dwelling to the same location as containers for refuse are kept.
D. 
Notwithstanding Subsections (A) and (C), residents of apartments and other multiple-family dwellings of more than six (6) units shall be furnished with a commercial recyclables bin instead of individual recyclables containers. Said bin shall be permanently placed on the premises at a convenient location for the residents. Pickups shall be made by the contractor directly from the bin.
E. 
Neither the foregoing provisions of this Section nor any other provisions of this Article shall prevent any resident from discarding that resident's recyclables by personally delivering them to a recycling plant, centralized collection site, manufacturer, or other vendor, or donating the same to non-profit civic, charitable or service organizations.
F. 
The City may designate a central collection site for the discarding of recyclables.

Recyclables shall not, in any event, be deposited in any landfill, be burned in any incinerator or be deposited or distributed in any way or manner which is contrary to the applicable law, Statute, ordinance, rule or regulation. Residents who elect to participate in the recyclable program shall take such action as is reasonable under the circumstances to determine that recyclables are not disposed of contrary to the provisions of this Section. The City maintains the right to contractor's waste tickets to make sure recycling is being done by hauler.

All recyclable materials shall be owned by and be the responsibility of the residents of premises until they are collected by the collector at curbside. Upon collection of the recyclable materials at the curbside by the collector, the recyclable materials, with the exception of recyclables containers which are reusable, become the property and responsibility of the contractor.

Each resident shall be responsible for the cleanliness and proper care of each recyclables container in his/her possession. Abuse of the container will cause the forfeit of a resident's right to a free replacement container when necessary.

A. 
Prohibited Acts. It shall be unlawful for any person to dispose, discard, dump, leave or otherwise abandon any material, garbage, refuse, or waste at the Recycling Center unless the material, garbage, refuse or waste is a recyclable material as defined by Section 230.180.
B. 
Penalty. Any person violating any of the provisions of this Section, upon conviction, shall be punished by a fine of not less than five dollars ($5.00) nor more than five hundred dollars ($500.00); provided that each day's violation thereof shall be a separate offense for the purpose hereof.
