This Chapter shall not be interpreted to restrict the use of buildings, structures or land of the local, State or Federal Government or the free exercise of religion.

The provisions of this Chapter shall be held to be minimum requirements adopted for the promotion of public health, morals, safety or the general welfare. Whenever the requirements of the Zoning Ordinance are at variance with the requirements of any other lawfully adopted rules, regulations or ordinances, the most restrictive, or that imposing the higher standards, shall govern.

If any Section, Subsection, sentence, clause or phrase of this Chapter is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Chapter.

A. 
Whenever the Zoning Administrator determines that there has been a violation of this Code or has grounds to believe that a violation has occurred, a notice of violation shall be given to the owner or the person or persons responsible therefore. All notices of violation shall comply with the following:
1. 
Shall be in writing.
2. 
Shall include a description of the parcel affected sufficient for identification.
3. 
Shall include a statement of violations.
4. 
Shall include a correction order, allowing reasonable time to take corrective action.
5. 
Shall inform the property owner of the right to appeal.
6. 
Shall be delivered personally, sent by certified first class mail to the last known address, or shall be posted at the premises.

Failure to comply with this Chapter shall be an ordinance violation punishable by a fine of not less than ten dollars ($10.00) and not more than one hundred dollars ($100.00) for each and every day that such violation continues, but if the offense be willful on conviction thereof, the punishment shall be a fine of not less than one hundred dollars ($100.00) or more than two hundred fifty dollars ($250.00) for each and every day that such violation shall continue or by imprisonment for ten (10) days for each and every day such violation shall continue or by both such fine and imprisonment in the discretion of the court.

Notwithstanding the requirements of Section 405.320, Section 405.340, and Section 410.100, all applications shall be accompanied by a fee as designated by Table O at the end of this Title. The Zoning Administrator shall be permitted to establish a refund policy. No fee shall be refunded for failure to act in favor of the applicant.
