As used in this Article, the following words and phrases shall have the meanings respectively ascribed to them:
APPROVED TEST
The test required by the Board of Examiners to assist in determining the competency of an applicant for a building contractor license to understand and determine the local building or zoning code requirements related to the specific trade for which application is made.
DRAINLAYER CONTRACTOR
A contractor who engages in the work of installing or altering any sanitary or storm sewer system including, but not limited to, pipes, valves, hydrants, manholes, meters, water services, sanitary sewer services, septic systems and related appurtenances.
ELECTRICAL CONTRACTOR, COMMUNICATIONS AND LOW VOLTAGE SYSTEMS
A contractor who engages in the work of installing or altering any fire alarm or fire prevention system, any communication or low voltage power in or on any building or premise; or for installing, erecting or altering electrical apparatus for remote controls or systems that are pertinent to public health or safety; or grounding or bonding of any type, including static or cathodic; and all raceways. This shall include, but not be limited to, all circuits or systems, such as fire alarms, security devices, card readers, and burglar alarms that interface with or control building systems or circuits, which are interrupted or completed by remote means, such as AC/DC, radio frequencies of any kind, radio frequency shielding, optical fiber cables and raceways, closed loop and programmed power distribution, photocells, or laser or any work or part thereof, as specified in the adopted life-safety codes.
ELECTRICAL CONTRACTOR, LIGHT COMMERCIAL

GENERAL CONTRACTOR, LIGHT COMMERCIAL
A contractor who engages in the work of general construction or general contracting to construct, alter, repair, modify, or change the use of any light commercial building or structure, or one- and two-family dwelling.
GENERAL CONTRACTOR, NON-EXCLUSIVE
A contractor who engages in the work of general construction or general contracting to construct, alter, repair, modify, or change the use of any building or structure.
GENERAL CONTRACTOR, ONE- AND TWO-FAMILY DWELLING
A contractor who engages in the work of general construction or general contracting to construct, alter, repair, or modify any one- and two-family dwelling.
HOME IMPROVEMENT CONTRACTOR
A contractor who engages in the work of general home improvement including work to alter, repair or modify a one- and two-family dwelling and its plumbing, mechanical and electrical systems.
LIGHT COMMERCIAL
Work for and limited to a single-story building or structure with a total aggregate area of less than five thousand (5,000) square feet for the following uses as defined under the adopted building and fire codes: Assembly ("A-1", "A-2", "A-3", "A-4", and "A-5"), Storage ("S-1" and "S-2"), High Hazard ("H-1", "H-2", "H-3", "H-4", and "H-5"), Institutional ("I-1", "I-2", "I-3", and "I-4"), Mixed Use or ("R-1", "R-2", and "R-3"), or less than nine thousand (9,000) total aggregate square feet for a Business (B), Mercantile (M), Utility (U), or residential town houses designed to comply with the adopted Residential Code.
MECHANICAL CONTRACTOR, NON-EXCLUSIVE
A contractor who engages in the work of installing or altering any mechanical fixture, apparatus, equipment or components thereof used in the installation of a mechanical system within or adjacent to any structure.
MECHANICAL CONTRACTOR, ONE- AND TWO-FAMILY DWELLING
A contractor who engages in the work of installing or altering any mechanical fixture, apparatus, equipment or components thereof used in the installation of a mechanical system within, or adjacent to, any one- and two-family dwelling.
MISCELLANEOUS CONTRACTOR
A contractor who engages in the work of a contractor not listed elsewhere in this Chapter. Miscellaneous contractors include, but are not limited to: roofing contractors, framing contractors, concrete contractors, drywall contractors, plasterers, masons, cabinet installers, fence installers, swimming pool installers, sign installers, irrigation system installers, and excavators.
PLUMBING CONTRACTOR, NON-EXCLUSIVE
A contractor who engages in the work of installing or altering any plumbing fixture, apparatus, equipment or components thereof used in the installation of a plumbing system within, or adjacent to, any structure.
PLUMBING CONTRACTOR, ONE- AND TWO-FAMILY DWELLING
A contractor who engages in the work of installing or altering any plumbing fixture, apparatus, equipment, or components thereof within or adjacent to any one- and two-family dwelling.
SPRINKLERFITTER CONTRACTOR
A contractor who engages in the work of installing or altering any fire prevention system apparatus, equipment, or components thereof used in the installation of a sprinkler system within, or for any structure.

A. 
There is hereby created a Board of Examiners consisting of the Mayor, a member of the City Council appointed by the Council, a member of the Building Code Advisory Board appointed by the Board, and two (2) citizen members appointed by the Mayor with approval of the City Council.
B. 
It shall be the duty of the Board of Examiners to adopt procedures for the purpose of examining the qualifications of all applicants for a license as required by this Article as to their knowledge of, and ability to perform, the duties and services of the construction trade for which the application is made.
C. 
The Board of Examiners shall review the contractor licensing requirements of other governmental entities, and may adopt rules to waive the examination requirements for applicants that hold similar licenses issued by other governmental entities, that have examination requirements equal to or greater than the requirements of this Article.

A. 
No person shall engage in the business of, or perform work as a contractor in the City of Farmington in connection with, either directly or indirectly, the building or construction of any structure, plumbing system, electrical system, mechanical system, or other related building components until they have applied for and procured a license from the City pursuant to this Article.
B. 
A person licensed as a building contractor may engage in performance of work as a contractor only for the work for which they are licensed pursuant to following Sections of this Article.
C. 
No contractor shall perform work or hold itself out in any advertising medium or publication as being available to perform work in the City of Farmington unless licensed pursuant to this Article.
D. 
Notwithstanding Section 605.050, all licenses granted under the provisions of this Article shall commence on the first (1st) day of January in each year and shall expire on the thirty-first (31st) day of December of the same year of issuance. The amount collected for any license issued shall be in such proportion to the rate fixed for one (1) year's license as the length of time for which the license is issued bears to one (1) year, and in prorating the amount of license tax to be paid for any period less than one (1) year, a fraction of a month shall be counted as a whole month.
E. 
Notwithstanding the provisions of Subsection (B) outlined above, until January 1, 2012, any contractor may be exempted from the testing requirements contained in this Section, until December 31, 2013 at which time they must have passed an approved test. No contractor will be granted a license pursuant to this Subsection until they submit a notarized statement of proof that the applicant:
1. 
Is at least twenty-one (21) years of age,
2. 
Has drawn from City of Farmington, or from a valid jurisdiction that enforces an equal or greater standard as the current adopted building code enforced by the City of Farmington, a minimum of twenty (20) permits within the previous three (3) years,
3. 
Has a minimum of two (2) years exclusive experience in the construction trade for which a license application is made,
4. 
Has not had more than three (3) complaints filed with the City of Farmington,
5. 
Has not had more than two (2) major code violations, as determined by the Board of Examiners.
Examples of major code violations shall include, but are not limited to, the following: failing to acquire the proper permits, violations of a stop work order, installing an improperly designed system, installing improper materials or poor workmanship.

A. 
Each application for a license pursuant to this Article shall be accompanied with a public liability and property damage insurance policy with coverage to name and protect the City and the contractor from all claims for damages for personal injury, including accidental death, as well as claims for property damages, which may arise from work performed, whether such claim be a result of actions by the contractor or any subcontractor performing work on behalf of the contractor. The insurance policy shall be not less than five hundred thousand dollars ($500,000.00) personal injury per occurrence and not less than five hundred thousand dollars ($500,000.00) aggregate property damage.
B. 
As a condition of receiving an occupational or business license from the City of Farmington, any contractor in the construction industry, as that term is defined in Chapter 287, Section 287.061, RSMo., shall provide, with its application for an occupational or business license, a certificate of insurance for Workers' Compensation coverage or an affidavit, in the form developed by the Division of Workers' Compensation for the State of Missouri, signed by the applicant attesting that the contractor is exempt from such coverage.
C. 
Each application shall be accompanied with a bond in the amount of ten thousand dollars ($10,000.00) for commercial and industrial contractors, and five thousand dollars ($5,000.00) for residential and light commercial contractors conditioned upon faithful compliance with the adopted building code and other permit requirements. The bond shall be payable to the City of Farmington, and issued by an institution authorized to issue such bonds in the State of Missouri.
D. 
Upon determination by the Building Official that a contractor has failed to construct, modify, or repair a system in compliance with the building code, the Building Official shall notify the contractor that its security required under Subsection (C) of this Section may be claimed if the non-compliant condition is not corrected within thirty (30) days' notice. The City of Farmington may expend whatever portion of the security as necessary to hire a licensed contractor to abate the non-compliant condition.

A. 
A contractor applying for a plumbing contractor, non-exclusive license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years, and satisfies one (1) of the following experience requirements:
1. 
A graduate of a bona fide trade school and has at least two (2) years of practical experience on plumbing work or has had at least one (1) year of practical experience in planning, laying out, supervising and installing plumbing appurtenances within or adjacent to any structure; or
2. 
At least three (3) years of experience in installing, altering or repairing piping, fixtures, plumbing appurtenances, venting systems and public or private water supply systems. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the plumbing industry; or
3. 
A graduate of any two (2) year bona fide trade school or technical college and one (1) year of practical experience in installing, altering or repairing piping, fixtures, plumbing appurtenances, venting systems and public or private water supply systems.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the plumbing industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for a plumbing contractor, one- and two-family license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years, and satisfies one (1) of the following experience requirements:
1. 
A graduate of a bona fide trade school and has at least two (2) years of practical experience on plumbing work or has had at least one (1) year of practical experience in planning, laying out, supervising and installing plumbing appurtenances within or adjacent to any structure, or
2. 
At least three (3) years of experience in installing, altering or repairing piping, fixtures, plumbing appurtenances, venting systems and public or private water supply systems. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the plumbing industry, or
3. 
A graduate of any two (2) year bona fide trade school or technical college and one (1) year of practical experience in installing, altering or repairing piping, fixtures, plumbing appurtenances, venting systems and public or private water supply systems.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the plumbing industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for a drainlayer contractor license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years, and satisfies one (1) of the following experience requirements:
1. 
At least three (3) years of experience in drainlaying under the direction of a drainlayer, or under laws and regulations requiring similar qualifications; or
2. 
A degree in civil or mechanical engineering from an accredited college or university, and three (3) years experience in design, installation and planning of private and public sanitary or storm sewer systems.
No credit shall be granted any applicant for experience gained while doing work that is ordinarily incidental to the drainlaying industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for a sprinklerfitter contractor license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and possesses a National Institute for Certification in Engineering Technologies (NICET) Fire Protection Level II Certification.
1. 
At least three (3) years of training and/or experience as a sprinklerfitter; or
2. 
At least three (3) years experience with a reputable, bona fide fire suppression sprinkler system contractor.
No credit shall be granted any applicant for experience gained while doing work which is ordinarily incidental to the sprinklerfitter industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for an electrical contractor, non-exclusive license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years, and satisfies one (1) of the following experience requirements:
1. 
A graduate of an electrical trade school and has at least two (2) years of practical experience on electrical work or has had at least one (1) year of practical experience in planning, laying out, supervising and installing electrical appurtenances within or adjacent to any structure, or
2. 
At least three (3) years of experience in installing, altering or repairing electrical systems greater than 24v. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the commercial or industrial electrical industry; or
3. 
A graduate of any two (2) year bona fide trade school or technical college and has had one (1) year of practical experience in installing, altering or repairing electrical systems greater than 24v.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the electrical industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for an electrical contractor, light commercial license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test for a light commercial electrician within the past six (6) years and satisfies one (1) of the following experience requirements:
1. 
A graduate of an electrical trade school and has at least two (2) years of practical experience on electrical work, or has had at least one (1) year of practical experience in planning, laying out, supervising and installing electrical appurtenances within or adjacent to any structure; or
2. 
At least three (3) years of experience in installing, altering or repairing electrical systems greater than 24v. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the commercial or industrial electrical industry; or
3. 
A graduate of any two (2) year bona fide trade school or technical college and has had one (1) year of practical experience in installing electrical appurtenances within or adjacent to any structure.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the electrical industry or for any experience gained illegally as determined by the Board of Examiners.

A contractor applying for an electrical contractor, communications and low voltage systems license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years.

A. 
A contractor applying for a mechanical contractor, non-exclusive license must demonstrate that at least one (1) employee is at least twenty-one (21) years of age and has passed the approved test within the past six (6) years, and satisfies one (1) of the following experience requirements:
1. 
A graduate of a mechanical trade school and has at least two (2) years of practical experience on mechanical systems, or has had at least one (1) year of practical experience in planning, laying out, supervising and installing mechanical appurtenances within or adjacent to any structure; or
2. 
At least three (3) years of experience in installing, altering or repairing mechanical systems, fixtures, appurtenances, venting systems, and associated supply and return systems. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the mechanical industry; or
3. 
A graduate of any two (2) year bona fide trade school or technical college and has had one (1) year of practical experience in installing, altering or repairing mechanical systems, fixtures, appurtenances, venting systems, and associated supply and return systems.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the mechanical industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
A contractor applying for a general home improvement or miscellaneous contractor license must demonstrate that at least one (1) employee is at least (21) years of age, and satisfies one (1) of the following experience requirements:
1. 
A graduate of a trade school and has at least two (2) years of practical experience on general construction, home improvement, or miscellaneous work or has had at least one (1) year of practical experience in planning, laying out, supervising and installing general construction appurtenances within or adjacent to any structure; or
2. 
At least three (3) years of experience in installing, altering or repairing general building components or systems. In lieu of experience, credit may be allowed for each year of successful completion of a bona fide trade school if the majority of courses taken by the applicant were primarily directed at education in the general construction industry; or
3. 
A graduate of any two (2) year bona fide trade school or technical college and has had one (1) year of practical experience in general construction, home improvement, or miscellaneous building construction work.
No credit shall be granted for experience gained while doing work that is ordinarily incidental to the construction industry or for any experience gained illegally as determined by the Board of Examiners.

A. 
The Board of Examiners shall be authorized to suspend any license issued pursuant to this Section when it determines any of the following:
1. 
That the licensee intentionally violated any of the provisions of this Building Code, or
2. 
That the licensee was negligent, unfit or incompetent in performing work, or
3. 
That the licensee obtained permits for a contractor not licensed by the City or not in the licensee's employ or supervision, or
4. 
That the licensee is in arrears on payment of required permit fees, or
5. 
That the licensee failed to maintain the proper security or certificate of insurance.
B. 
The Board of Examiners shall notify the licensee of the alleged violation(s) in writing. Such notification shall occur by certified mail or personal service. The written notification shall also state the time and place that the Board of Examiners will hear the alleged violations. The license holder and all other interested parties may be in attendance.
C. 
After the opportunity for a hearing and upon the Board of Examiners finding that any of the acts or omissions described in Subsection (A) of this Section have been committed, the Board of Examiners may at its option:
1. 
Suspend the license for up to thirty (30) days, and the licensee may be placed on probation for up to sixty (60) days if it is the licensee's first (1st) violation, or
2. 
Suspend the license for up to sixty (60) days and the licensee may be placed on probation for up to one hundred eighty (180) days if it is the licensee's second (2nd) or more violation in any two (2) year period, or
3. 
Suspend the license for up to one (1) year if a violation occurs during a suspension or probationary period.

Any person shall have the right to appeal a decision of the Board of Examiners to the City Council. An application for appeal shall be based on a claim that the true intent of the licensure rules legally adopted thereunder has been incorrectly interpreted, or the provisions do not fully apply. The application shall be filed on a form obtained from the Building Official within thirty (30) days after the notice was served or a license application was denied.

A processing fee of one hundred dollars ($100.00) minimum shall be paid by all persons submitting an application for an appeal.
