A.
This Town Board finds that skateboards, scooters, in-line skates,
and other similar devices are used in the Town of North Hempstead.
B.
This Town Board finds that skateboards, scooters, in-line skates,
and other similar devices in areas with steep inclines within the
Town of North Hempstead pose a public danger to pedestrians, drivers,
and the users of these devices.
C.
Therefore, the purpose of this chapter is to protect the public health,
welfare, safety, peace and tranquility by regulating the operation
of skateboards, scooters, in-line skates and other similar devices
in areas with steep inclines within the Town of North Hempstead.
As used in this chapter, the following terms shall have the
meanings indicated:
Boots or shoes with one or more rows of wheels attached to
the soles.
Skateboards, scooters, in-line skates or other similar devices,
but excluding devices for the assistance of the physically disabled.
A skateboard that also includes a vertical bar and handlebar
used for steering purposes.
A board of wood, plastic, metal or fiberglass or similar
material with roller skates or other type of wheels attached and used
for gliding or moving on any hard surface.
Any person who violates the provisions of this chapter shall
be guilty of a violation, punishable by a fine not to exceed $250
for the first offense. For each offense thereafter, the fine shall
be no more than $500.
Code Enforcement Officers of the Town of North Hempstead, as
well as police officers having jurisdiction, shall have the authority
to enforce the provisions of this chapter.
If any clause, sentence, paragraph, section, word or part of
this chapter is adjudged by any court of competent jurisdiction to
be invalid, the judgment shall not affect, impair or invalidate the
remainder of this chapter but shall be confined in its operation to
the clause, sentence, paragraph, section, word or part of this chapter
directly involved in the controversy in which judgment is rendered.
This chapter shall take effect immediately upon filing with
the Secretary of State.
