This chapter is enacted on the authority of the Borough Code of the Commonwealth of Pennsylvania as hereafter amended, supplemented, modified or re-enacted by the General Assembly of the Commonwealth of Pennsylvania. A certain document, three copies of which are on file in the office of the Burgettstown Borough Secretary, being marked and designated as the International Property Maintenance Code, 2018 edition, together with any all later versions of the Code that may be hereafter later promulgated and published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Burgettstown Borough, in the Commonwealth of Pennsylvania, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Property Maintenance Code on file in the office of the Township Secretary are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 385-2 of this chapter.

The following sections are hereby revised:
A. 
Section 101.1: insert "the Borough of Burgettstown."
B. 
Section 103.5: insert "Shall be established by resolution by the Borough Council."
C. 
Section 106.4: insert at the end of this code section "Any person found to have violated any portion of this Code shall pay a fine of not less than $200 and not more than $1,000, if a fine for said violation is not otherwise provided for."
D. 
Section 112.4: insert "$200" and "$1,000."
E. 
Section 302.4: insert "10 inches."
F. 
Section 304.14: insert "March 30" and "October 30."
G. 
Section 602.3: insert "September 1" and "May 30."
H. 
Section 602.4: insert "September 1" and "May 30."

Any and all previously enacted ordinances and/or amendments thereto that conflict with this chapter are hereby repealed to the extent of said conflict.

Nothing in this chapter or in the Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this chapter.
The Borough Secretary-Treasurer and/or Solicitor shall certify to the adoption of this chapter and cause the same to be published as required by law, and this chapter shall take effect and be in force from and after its approval as required by law.
