The Grantor shall exercise appropriate regulatory authority under the provisions of this Chapter and applicable law. Grantor, by passage and approval of this Chapter hereby confirms, participation with other governmental entities in a joint regulatory agency, with delegated responsibility in the area of cable and related communications — said agency being defined as NATA.

A. 
The Grantor, acting jointly with other Grantors, hereby delegates the following regulatory responsibilities to NATA:
1. 
Administration and enforcement. Administration and enforcement of the provisions of the Broadband Communications Network franchise award ordinance(s).
2. 
Coordination. Coordination of the operation of public, governmental and/or educational channels, if any.
3. 
Support to public agency users. Provision of technical, programming and operational support to public agency users, such as City departments, schools and health care institutions.
4. 
Procedures and standards for institutional operations. Establishment of procedures and standards for institutional operations and services, use of dedicated channels, and sharing of public facilities.
5. 
Planning. Planning of expansion and growth of services, including interconnection of various systems.
6. 
Interconnection. Analysis of the possibility of integrating the Cable Communications Systems with other City, County, State or regional telecommunications networks.
7. 
Policy. Formulation and recommendation of long range telecommunications policy for the City.
8. 
Community channels. Selection and implementation of all things necessary to establish an entity that would ensure access to community channels that serve the public interest.

A. 
Initial Rates. The City reserves the right, power and authority to regulate rates, having found that effective competition, as defined in Section 623 of the Cable Communications Policy Act of 1984, as amended, and applicable regulations, does not exist. The level(s) regulated shall be set out in the franchise award ordinance.
B. 
Rate Regulation. If the City shall assume the authority to regulate rates, it shall do so in accordance with applicable State and Federal laws.
