GARBAGE, RUBBISH and REFUSE
RECYCLABLE MATERIAL
Definitions of certain words used in this article are as follows:
Includes kitchen waste, all refuse of animal or vegetable
matter, carrion, entrails or other parts of poultry, animals and fish,
and matter or substance of a similar nature, paper bags or lining
or other types of linings used in garbage cans, household waste, rugs,
mattresses, wood products and like materials.
Those items which are included in Article V, Recycling, of this chapter, such as paper items, metal and white goods, leaves and tree waste.
B.Â
Word usage. "He" or "his" shall mean singular and plural, male and
female or neuter gender.
A.Â
It shall
be unlawful for any person to place or cause or suffer to be placed
upon any vacant lot, street, alley, driveway, sidewalk, curbing, areaway
or any other public place any refuse or garbage, as herein defined,
or to distribute such material when properly placed as hereinafter
defined, except in compliance with the provisions of this article.
Every person who owns or occupies property shall keep the sidewalk
in front of his or her premises free of litter and shall collect and
properly containerize for disposal all sweepings.
B.Â
It shall
be unlawful for any homeowner, tenant of a single- or two-family home,
or owner or tenants of multifamily rental units, stores or other buildings
to place or cause or suffer to be placed upon any street, sidewalk,
gutter, areaway or public place any garbage, trash or recyclable material
except in compliance with the provisions of this article.
It shall be unlawful for any unauthorized person to remove garbage,
trash or recyclable material from the streets or sidewalks of the
Borough.
The following regulations shall govern the collection and removal
of trash and garbage from homeowners, tenants of single- or two-family
homes and owners or tenants of multifamily rental units, stores or
other buildings who utilize the Borough of Bellmawr or its authorized
agent for the collection of solid waste:
A.Â
The user of the Borough solid waste removal service shall place the
required receptacles prior to collection between the curb and sidewalk
of his property or such other appropriate place adjacent to the nearest
public street.
B.Â
The receptacles herein required, together with their contents, shall
be of such weights and design as to be conveniently handled by one
man, and the receptacles and contents shall not weigh more than 50
pounds. No trash or bags in paper or plastic bags outside of a proper
receptacle will be collected, and the placing of the same at curbside
shall be a violation of this article.
C.Â
The receptacles or other items to be disposed of shall be placed
outside at the designated area after 6:00 p.m. of the day preceding
the day of collection and no later than 6:00 a.m. of the day of collection.
After collection, any empty containers shall be removed from the curbside
promptly, but not later than 7:00 p.m. of the day of collection.
D.Â
The receptacle in which garbage is placed shall be a watertight container
with a lid to properly fit said container so as to prevent the garbage
from being distributed over the surface of any street, byway or public
place; provided, however, that it shall be lawful to securely wrap
garbage in stout paper packages, provided that said packages are placed
within the receptacle.
E.Â
In areas where multiple dwelling common collection points are utilized,
each receptacle must be clearly marked with the residential address
permanently placed on the receptacle.
F.Â
Improper disposal of hypodermic needles will result in discontinuation
of trash service. If a violation occurs, trash service will be discontinued
until the resident is enrolled into a safe syringe disposal program.
Any homeowners, tenants of single- or two-family homes and owners
of multifamily rental units, stores or other buildings who utilize
the Borough of Bellmawr or its authorized agent for the collection
of solid waste that violate or neglect to comply with any provision
of this article or any regulation promulgated pursuant thereto shall,
upon conviction of said violation, be fined the following amount for
the following offenses:
