The Mayor with the approval of a majority of the members of
the Board of Aldermen shall appoint a Chief of Police, who shall perform
all duties required of the Marshal by law and any other Police Officers
found by the Board of Aldermen to be necessary for the good government
of the City. The Chief of Police shall be twenty-one (21) years of
age or older.

The Mayor shall, at the regular meeting of the Board of Aldermen
in April of each year and at such times as a vacancy may exist, with
the consent and approval of the Board of Aldermen, appoint such number
of regular and reserve Policemen as he/she may deem necessary for
good and proper law enforcement in the City of Rogersville.

Each appointment of a regular Policemen as herein provided shall
be for the term extending until the provided, however, that all Policemen,
regular and reserve, shall at all times serve at the will of the Mayor
and the Board of Aldermen and may at any time, with or without cause
and by review of the City Attorney, be suspended by the Mayor alone
for a period not to exceed thirty (30) days and may at any time, with
or without cause, be removed from office by the Mayor with the consent
and approval of a majority of the Board of Aldermen and may be removed
by a three-fourths (¾) majority of the Board of Aldermen without
the consent of the Mayor.

In addition to the regular Policemen herein provided, the Mayor may, with the consent and approval of the Board of Aldermen, appoint such reserve Policemen not exceeding a total of ten (10) in number for such term as he/she may deem necessary for good and proper law enforcement in the City of Rogersville, Missouri. During their term, reserve Policemen shall possess all the powers of a regular Policemen and be subject to the provisions of Section 200.030 herein for their removal as provided for regular Policemen.

All persons appointed to the office of Chief of Police or full-time
regular Police Officer shall be at least twenty-one (21) years of
age. All persons appointed to the position of reserve Police Officer
shall be at least twenty-one (21) years of age. All persons appointed
to a position of Policeman, whether as Chief of Police, full-time
regular Police Officer, or reserve Police Officer, shall be a qualified
voter of the State of Missouri and have completed State certification
as required by Section 590.105, RSMo.

Each appointment of a regular or reserve Policeman as herein
provided shall be in writing. It shall designate the person appointed,
whether a regular or reserve Policeman, and the effective date of
appointment. The oath of office of each appointed Policeman shall
be signed by him/her and Mayor and attested by the City Clerk. The
officer shall be given the oath of office by the City Clerk in a swearing
in session.

No appointment shall be effective until filed with the City
Clerk and when an appointment is filed, it is hereby made the duty
of the City Clerk to promptly and correctly endorse thereon the date
of filing and to carefully preserve as a public record all appointments
for the term thereof.

For any expense incurred by the Policeman in the use of his/her
private automobile in serving or executing any warrant, subpoena,
writ or other process outside the limits of the City of Rogersville,
Missouri, upon his/her certification of the number of miles actually
and necessarily traveled, any Policeman shall be paid at the end of
each month at the same rate as then in effect as the Internal Revenue
Service mileage deduction rate.

All Policemen, regular and reserve, shall be under the control
and supervision of the Chief of Police.

All Policemen, regular and reserve, shall have power to serve
and execute all warrants, subpoenas, writs or other process in the
same manner as the Chief of Police and shall have the power to make
arrests in the same manner as provided by law or ordinance for the
Chief of Police. It is hereby made their duty to enforce all laws
of the State of Missouri and the City of Rogersville, Missouri.

The Mayor, with the consent and approval of the Board of Aldermen,
is hereby empowered and authorized to make rules and regulations not
inconsistent with the ordinances of the City of Rogersville for the
further governing of the Police force of the City of Rogersville.
All rules and regulations promulgated by the Mayor and approved by
the Board of Aldermen shall be dated and filed with the City Clerk
as a public record and shall be binding upon all Policemen.

A.Â
The
City of Rogersville Police Department may provide Police security
to businesses outside of the City limits.
B.Â
The
City of Rogersville shall charge the businesses a fair and reasonable
amount for this service. The monthly amount charged will be determined
by the length of time taken to check buildings, doors, etc.

A.Â
Any
Police Officer of the City of Rogersville shall have the authority
to respond to an emergency situation outside the City boundaries when
the emergency situation arises.
B.Â
Any
Police Officer of the City of Rogersville shall have the authority
to respond to an emergency situation outside the City boundaries when
the emergency situation arises with any political subdivision that
also has authorized its Police Officers to respond to emergency situations
arising within the City.
C.Â
Deputies
of the County Sheriff's Department are hereby authorized to respond
to any emergency situation arising in the City of Rogersville, Missouri,
after receiving a request for assistance from the Rogersville Police
Department or one (1) of its Law Enforcement Officers.
D.Â
Police
Officers of any political subdivision that has authorized its Police
Officers to respond within the City of Rogersville, Missouri, after
receiving a request for assistance from the Rogersville Police Department
or one (1) of its Law Enforcement Officers.
E.Â
As
used in this Section, "Police Officer" means an officer
who has completed the basic police training program promulgated by
Chapter 590, RSMo. As used in this Section, "respond" shall mean to take any and all actions which the Police Officer
may lawfully take as if exercising his/her powers within the jurisdiction
of his/her employing City. As used in this Section, "emergency
situation" means any situation in which the officer has a
reasonable belief that a crime is about to be committed, is being
committed, or has been committed involving injury or threat of injury
to any person, property or governmental interest and that his/her
response is reasonably necessary to prevent or end such emergency
situation or mitigate the likelihood of injury involved in such emergency
situation.
