No person shall excavate in, through or under any street, sidewalk,
alley or other public place, in the City without first securing a
right-of-way permit therefor from the City.
All applications for permits required by this Article shall
be signed by the person who desired to do the work designated in said
application. The application shall not be assignable and shall be
used only by the person desiring to make such further excavation.
No person shall allow or permit his/her name to be used to obtain
a permit or permits, for any other person.

Any person doing any type of excavation in a public right-of-way
which would require the street, curb, or sidewalk to be cut and or
removed, shall be required to pay the appropriate right-of-way permit
fee and street cut fee according to the Schedule of Fees, Title I,
Appendix A for such work.

The person doing the cutting or excavating under a permit issued
pursuant to this Article shall cause the same to be done with the
least possible injury to the pavement, sidewalk or other surface,
and place the materials therefrom where it will cause the least possible
inconvenience to the public and permit the uninterrupted passage of
water along the gutters, and width of the excavation shall be no greater
than is necessary for doing the work.
The person making any cut or excavation pursuant to a permit
issued under this Article, shall notify the City Public Works Department
at least eight (8) hours prior to the commencement of refilling any
cut or excavation. The refilling and repairing shall be done pursuant
to such specification of the Public Works Department.
With proper notification and permits as required by this Article,
the person doing the cutting or excavating shall make proper filling
of said cutting or excavation and immediately after same clean up
and haul away all surplus earth, rock or rubbish therefrom according
to the Public Works Standards of Construction.

No ditching, pipelaying, grading or other excavating or any
similar type machine shall be used or operated upon the streets and
the dedicated rights-of-way for same on any Sunday or any holiday;
provided, however, in case of an emergency said machines may be operated
on the prohibited days when permission to do so has been obtained
from the City Manager or the Manager of the City Waterworks System.
Any person who has made an excavation in any of the streets,
sidewalks, alleys or other public places in this City shall cause
such excavation to be barricaded in such manner as to adequately protect
traffic, both vehicular and pedestrian, and shall cause such excavations,
barricades, excavated materials, tools, supplies or equipment at such
excavated area to be lighted with proper and suitable danger signals
in such manner that all traffic may be amply and duly warned of the
existence of such excavations, barricades, materials, tools, supplies
or equipment according to the Manual of Uniform Traffic Devices.
