There is hereby created the office
of City Attorney. The City Attorney shall be appointed by the Mayor
with the approval of the majority of the members of the Board of Aldermen.
The City Attorney shall attend the meetings of the Board of Aldermen,
advise the various City Officers, committees and boards upon legal
questions pertaining to their respective duties for the City, draw
ordinances, deeds, releases, assessments, contracts, bonds and other
documents relating to municipal affairs, represent the City in all
litigation in the courts and before administrative State and Federal
agencies. The City Attorney shall be a lawyer licensed to practice
in the courts of the State of Missouri. The City Attorney shall receive
such compensation for the performance of his/her duties as may be
determined by the Board of Aldermen by ordinance from time to time.

The City Attorney shall attend all
meetings of the Board of Aldermen unless excused by the Mayor or a
majority of the Board of Aldermen. Any member of the Board of Aldermen
shall confer with the Mayor and other Aldermen before calling upon
the City Attorney for an oral or written opinion to decide any question
of law, but not to decide upon any parliamentary rules or to resolve
any dispute over the propriety of proposed legislative action.

A. There is hereby created the position of Municipal Prosecuting Attorney. The Municipal Prosecuting Attorney shall be selected and appointed consistent with all provisions of Section
115.130 of the Gerald Municipal Code as reserved for special counsel.
B. The compensation for such position shall
be fixed by the Board of Aldermen and may be amended from time to
time.
C. The Municipal Prosecuting Attorney shall
pursue and prosecute any violation of the Municipal Code and shall
report to the Board of Aldermen, as required by the Board, on the
condition of any matters pending or unsettled in the Circuit Court,
or any offense being pursued or prosecuted by the City for violation
of City ordinances.

D. The Municipal Prosecuting Attorney shall,
at all times, be a licensed and practicing attorney in the State of
Missouri.
