As used in this chapter, the following terms shall have the meanings indicated:
DEPARTMENT
The Recreation Department, the Director of said Department, or a designated representative of the Director.
PARK, PARK AREAS, OR FACILITIES
All public parks, trails, areas, and facilities owned or managed by Peters Township.
PARTY
The individual, club, or group who makes a request for a special use.
RESIDENTS
All persons living in the Township and those owning real property within Township boundaries.
A. 
NONRESIDENTSShall refer to all other persons.
SPECIAL USE or RESERVATION
Any use of a park area or facility as requested by a party. The Recreation Department makes the final determination for the approval or denial of all special use requests. If approved, the area or facility will be reserved for the requested party's activity, which may be exclusive. There also may be a requirement for a deposit and rental fee to be paid.
SPECIAL USE POLICY
The document containing procedures and guidelines governing the treatment of requests to reserve park areas. The policy was adopted by the Township Council and became effective on February 1, 1985.
TOWNSHIP
Peters Township.
Requests by residents for special use can be accepted by the Department no more than six months (to the day) prior to the desired date. Nonresident requests will be accepted no more than two months prior to the special use.

A. 
May be required to be paid the Department for some special use requests. These damage/cleanup deposits will be determined by the Department.
B. 
The deposit required must always be presented to the Department in the form of a check (never cash) and be received at least one full working day preceding the special use. The check will be returned to the party if no damage nor excessive cleanup has been incurred by the Department.
C. 
If for any reason there is damage to any part of the park area, the Department shall determine the extent of damage and deduct the dollar amount from the deposit paid by the party. If the cleanup exceeds the routine duties required, a restitution fee shall be assessed and deducted from the deposit.
D. 
In either or both cases, if the amount of damage or extra cleanup required exceeds the deposit paid by the party, the Department may bill the party for the balance, to be paid in full no more than 30 days from the billing date. If payment is not received from the party within that time, all future special use requests will be denied until such time as payment is received. The foregoing provisions shall also apply in cases in which the party was not required to remit a deposit.
Fees for reservations shall be established for each budget year as part of the general fund budget, or may be established to underwrite a particular service as necessary. All fees must be received by the Department at least one full working day prior to the special use.

A. 
If the party cancels its special use at least 72 hours prior to the start of the reserved activity, the rental fee and any deposit will be refunded. If the party cancels its reservation with less than 72 hours prior to the special use, no refund will be granted.
B. 
If the reserved special use was unable to be conducted due to inclement weather or any condition which renders the facility/area unusable, a refund or rescheduling will be granted upon request, rain date identified in advance and, if used, must be treated as any other special use.
