A. The
Planning and Zoning Commission shall study the preliminary plat to
see if it conforms with the minimum standards and requirements of
this Code or other ordinances of the City and shall approve or reject
such plat within sixty (60) days after submission of the plat to the
Commission. The "date of submission", for purposes
of this Section, shall be defined as the date of the first (1st) regular
meeting of the Planning and Zoning Commission at which the preliminary
plat is first reviewed by the Commission. If the Commission does not
act within said sixty (60) day period of time, the preliminary plat
shall be deemed to be approved by the Commission and shall be forwarded
to the Board of Aldermen for their review.
B. If
the Planning and Zoning Commission does not approve the preliminary
plat of the subdivision, the Board of Aldermen may approve the preliminary
plat only by a two-thirds (⅔) vote of the membership of the
Board of Aldermen.
C. Approval of the preliminary plat by the Commission and/or the Board of Aldermen does not constitute an acceptance of the subdivision final plat. Preliminary plats not containing all of the data specified in Section
405.130 shall not be approved by the Planning and Zoning Commission and the Board of Aldermen.
