By adoption of this article, the Town Board of the Town of Mount
Hope declares its intent to regulate the disposal of any dirt, filth,
waste or rubbish in any street, highway or sidewalk in the Town of
Mount Hope, Orange County, New York, pursuant to Subdivision 7 of
§ 130 of the Town Law of the State of New York.
The Town Board of the Town of Mount Hope hereby prohibits the
unauthorized deposit of any dirt, filth, waste or rubbish in any street,
highway or sidewalk of the Town of Mount Hope including all public
highways without the corporate limits of the Village of Otisville.
This article shall not apply to the land located within the
corporate limits of the Village of Otisville but shall apply to all
other public highways in the Town of Mount Hope, Orange County, New
York.
Any person, firm or corporation who violates the provisions
of this article shall be guilty of an offense punishable by fine not
to exceed $500 or by imprisonment. Each day a violation continues
shall constitute a separate offense. In addition to the above-provided
penalty and punishment, the Town Board may also maintain an action
or proceeding in the name of the Town, in a court of competent jurisdiction,
to compel compliance with and/or to restrain by injunction any violation
of this article.
