Workforce Investment Board — See § 4-73.3.
As used herein, the following terms are defined as follows:
EMPLOYEE
Any person employed to perform any service by an employer at a place of business in Atlantic County.
EMPLOYER
Any person or legal entity that controls and directs an employee under an express or implied contract and pays, or is obligated to pay, him or her salary or wages in compensation.
Whenever any employer in Atlantic County is required to provide notice pursuant to N.J.S.A. 34:21-2(a) and/or 29 U.S.C. § 2102(a)(2) to the chief elected official of a local governmental unit or municipality, that notice shall simultaneously be provided to the County Executive of the County of Atlantic and the Chairman of the Atlantic County Board of County Commissioners.
A. 
Any employer required to provide notice pursuant to § 91-2 of this chapter shall also provide access to the Workforce Investment Board during regular business hours for the purposes of providing assistance to affected employees from such time as the notice is provided until the event triggering the notice occurs.
B. 
The Workforce Investment Board shall provide such assistance to employees only during, prior to, or after the commencement of an employee's shift, or during authorized breaks, unless expressly permitted by the employer.
C. 
To the extent possible, the Workforce Investment Board shall conduct its activities in a nonpublic area of the employer's business premises and in a manner designed to minimize the impact on the employer's business operations.
D. 
Notwithstanding any other provision of this section, if the employer provides a certification to the County Executive of the County of Atlantic and the Chairman of the Board of County Commissioners stating that it has provided the Workforce Investment Board with the name, address, telephone number, electronic mail address (if known), telephone number, and job title of each affected employee, the Workforce Investment Board shall not access the employer's job site.
A. 
The Department of Administration may issue such regulations as are necessary to administer the requirements of this chapter.
B. 
The County Executive of the County of Atlantic is authorized to take whatever actions he deems necessary and appropriate to enforce the provisions of this chapter, including, but not limited to, the filing of a lawsuit seeking a court order enforcing the provisions of the same.
