Borough of Sharon Hill, PA Article VIII Powers and Authority of Inspectors

§ 298-45 Right of entry to properties.

The Borough Superintendent or other duly authorized employee of the Borough of Sharon Hill bearing proper credentials and identification shall be permitted to enter all properties for the purposes of inspection, observation, measurements, sampling and testing the quantity and quality of waste discharges to the sewers or waterways or facilities for waste treatment in accordance with the provisions of this part of this chapter.

§ 298-46 Observance of safety rules required.

While performing the necessary work on private properties referred to in § 298-45 above, the Borough Superintendent or his duly authorized representative shall observe all safety rules applicable to the premises established by the owners of such private properties.

§ 298-47 Refusal to permit entry a violation.

Refusal to permit the entry upon private lands required to perform the necessary work referred to in § 298-41 above shall be punishable by such penalties as may be prescribed under Article IX, § 298-49.

§ 298-48 Right of entry to easements.

The Borough Superintendent and other duly authorized employees of the Borough of Sharon Hill bearing proper credentials and identification shall be permitted to enter all private properties through which the Borough holds a duly negotiated easement for the purposes of, but not limited to, inspection, observation, measurement, sampling, repair and maintenance of any portion of the sewage works lying within said easement. All entry and subsequent work, if any, on said easement shall be done in full accordance with the terms of the duly negotiated easement pertaining to the private property involved.
