Any vehicle found upon a public highway or public property in the Borough of Sharon Hill in violation of any ordinance of the Borough of Sharon Hill shall be removed upon the orders of the police or the Mayor of the Borough of Sharon Hill.

Removal and impounding of vehicles under this chapter shall be done only by approved storage garages that shall be designated as the pound. The Borough Council shall designate the pound from time to time by resolution.

Such pound shall submit evidence to the Borough that it is bonded or has acquired liability insurance in an amount satisfactory to the Borough as sufficient to indemnify owners of impounded vehicles against loss or damage to those vehicles while in the custody of the pound keeper for the purpose of towing or storage.

The pound shall submit to the Borough Council its schedule of charges for towing and storage of vehicles under this article and, when the schedule is approved by the Borough Council, those charges shall be adhered to by the approved storage garage; no different schedule of charges shall be demanded of or collected from any person whose vehicle is removed or impounded under this article by the pound. In addition to the charges charged by the pound hereunder, the owner of the vehicle shall pay a reclamation fee in the amount of $25 to the Borough of Sharon Hill, which shall cover administrative costs; proof of payment of the reclamation fee is required before the pound may release the vehicle. Such fees and charges stated herein may be amended from time to time by resolution of the Borough Council.
Within 12 hours from the time of the removal of any motor vehicle, notice of the fact that such motor vehicle has been impounded shall be sent by the Borough of Sharon Hill Police Department to the owner of record of such motor vehicle, designating the place from which said motor vehicle was removed, the reason for its removal and impounding and the pound in which it has been impounded.
The payment of any charges imposed under this article, unless such payments shall be made under protest, shall be final and conclusive and shall constitute a waiver of any right to recover this money so paid.
In the event that the removal, towing, storage and impounding charges are paid under protest, the person so paying shall be entitled to a hearing before a Magisterial District Judge, in which case said person shall be proceeded against and receive such notice as is provided by the Vehicle Code of the Commonwealth of Pennsylvania. The period of time in which the information under said Vehicle Code must be filed shall be computed from the date of the removal or towing or the date of payment under protest, whichever is later.
