It is hereby declared unlawful for any person to dump, place or deposit any loose papers, rubbish or waste matter in or upon any public highway of this Borough, and any such material falling from any conveyance upon any public highway of this Borough is hereby declared a violation of this chapter.
It shall be unlawful for any person to dump, place or deposit any paper, rubbish, ashes, empty cans or other waste material on any private property in this Borough without the express permission of the owner of such property, or to dump, place or deposit any such waste material on any property not designated by the owner as a public dump for which a license shall have been obtained as hereinafter provided.
It shall hereafter be unlawful for any property owner to use any private property in this Borough for the purpose of a public dump, or to permit the same to be used by others for dumping purposes, unless and until such property owner shall have made application to the Borough Council for a permit to maintain a public dump, which application shall state fully and accurately the applicant's title to the said property and the exact location and size thereof, and shall stipulate that no portion of this said property within an area or distance of 100 feet from any public road shall be used for such dump and that no combustible material shall be dumped upon any part of said property. Upon approval of such application by the Highway Committee, a permit shall be issued without any license fee being paid therefor, which permit shall be limited to one year and shall be subject to revocation at any time in the event that any dumping shall be done upon the said property within the restricted area of 100 feet from any public road or that combustible material shall be dumped upon any part of the said property.
It shall be unlawful for any person to deposit any combustible material on or to start any fire on or in the immediate proximity of any dumping place of this Borough.

Any person who shall be convicted of a violation of any of the provisions of this chapter before any Magisterial District Judge shall be sentenced to pay a maximum fine as provided from time to time by state statute, together with costs of prosecution, or to imprisonment in the county jail for a term not to exceed 30 days, or both.
