From and after the passage of this chapter, it shall be unlawful for any individual, firm or corporation to construct, maintain or operate or cause to be constructed, maintained or operated along any public highway within the limits of the Borough of Sharon Hill any refreshment or luncheon stand or any other stand, commonly known as a "road stand," where food or beverages or commodities of any kind are offered for public sale, except where an individual, firm or corporation rents space on a commercial lot with at least a one-hundred-foot frontage and a one-hundred-foot depth and said individual, firm or corporation presents a lease to the Borough of Sharon Hill.

Any person who shall be convicted of a violation of any of the provisions of this chapter before any Magisterial District Judge shall be sentenced to pay a maximum fine as provided from time to time by state statute, together with costs of prosecution, or to imprisonment in the county jail for a term not to exceed 30 days, or both. Each day such violation shall continue after notice to cease has been given in writing by a qualified officer of the Borough of Sharon Hill shall constitute a separate offense.
