This Satellite Antenna Ordinance is an ordinance to establish regulations governing the use and location of satellite antennas within Sharon Hill. Delaware County, Pennsylvania.
As used in this chapter, the following terms shall have the meanings indicated:
SATELLITE ANTENNA
A dish-shaped antenna, together with all attachments and parts, the purpose of which is to receive communication from orbiting satellites or other extraterrestrial sources.
USABLE SATELLITE SIGNAL
A satellite signal which, when viewed on a conventional television set, is at least equal in picture quality to that received from local commercial television stations or by way of cable television.
Whenever, in the course of administration and enforcement of this chapter, it is necessary or desirable to make any administrative decision, then, unless other standards are provided in the chapter, the decision shall be made so that the result will not be contrary to the spirit and purpose of this chapter or injurious to the surrounding neighborhood.
A.ย
Prior to installation of any satellite antenna, a permit application shall be made with the municipality.
B.ย
All applications must be accompanied by specific mounting and stress analysis designs, sealed by a registered engineer.
A.ย
The satellite antenna is to be considered an accessory structure and is, thereby, subject to all the height and setback requirements contained therein.
B.ย
Roof-mounted antennas shall not exceed the maximum allowable building height for the districts in which they are located.
A.ย
The satellite antennas are to be permitted in the side and rear yards and on roofs.
B.ย
In the event that a usable satellite signal cannot be obtained by locating the antenna in the side yard of the property, such antenna may be placed on the roof of the dwelling structure.
A.ย
The size limitations on the antenna are to be controlled by the following criteria:
(1)ย
If ground-mounted, the height limits of the accessory structure will limit the maximum diameter of the satellite antenna.
(2)ย
If roof-mounted, the maximum building height for the district will limit the maximum diameter of the satellite antenna.
B.ย
Every antenna must be adequately grounded for protection against a direct strike of lightning.
A.ย
Screening shall be required whenever possible, yet shall not be of a nature so as to obstruct the sight line of the antenna.
B.ย
Except in a commercial, industrial or multifamily residential zone, satellite antennas shall be located and designed so as to reduce visual impact from surrounding properties at street level and from public streets.
There shall be a maximum allowable limit of one satellite antenna per lot with the use limited to that lot on which it is located.
