Before any street or sidewalk in the Borough of Sharon Hill
shall be opened by anyone, it shall be necessary to obtain a permit
therefor from the Borough Manager, and the fee to be paid to the Borough,
for the Borough account, on application for a permit to open any paved
or unpaved street in the Borough of Sharon Hill shall be as set from
time to time by resolution of the Borough Council

A.
When the opening and replacement of a street or sidewalk is made by the Highway Department of the Borough of Sharon Hill, the sum as set by Borough Council per square yard shall be paid to the Borough, for the Borough account, for the opening and replacement of any concrete or macadam street or for the opening and replacement of any unimproved street or sidewalk. All street openings and replacements made by the Borough Highway Department will be made as prescribed in § 320-25 of this article. After repairs and replacements have been completed, the size of the patch shall be measured, and should the fee required be greater than the amount paid to the Borough, a bill will be rendered for the additional amount and collected as prescribed by law. Should the amount paid to the Borough be greater than the amount required, a refund will be made to the applicant.

B.
No street or sidewalk in the Borough of Sharon Hill shall be permitted
to remain open for any period of time in excess of 30 days.

When the opening and replacement of a street or sidewalk is
made by a permittee or an authorized employee of a permittee, such
permittee shall furnish the Borough of Sharon Hill with a bond in
the amount of $500. The permittee or an authorized employee of a permittee
shall at all times maintain sufficient guards by day and night to
prevent accidents from travel and shall be liable for any damage that
may arise from his neglect to do so or for any omission on his part
and shall indemnify and save harmless the Borough of Sharon Hill from
all suits or actions of any name or description brought against the
Borough on account of any act or omission on his part, and he shall
agree to have and maintain at all times during the progress of the
work a sufficient amount of liability insurance to cover all proper
claims. He shall further agree to have and maintain at all times during
the progress of the work a sufficient amount of workers' compensation
insurance to meet all possible claims of his employees and, before
starting any work, shall supply the Borough Manager with a certificate
from the insurance company showing that he carries such liability
and workers' compensation insurance.

A.
The replacement of any street or sidewalk by the Highway Department
of the Borough of Sharon Hill or by permittees or authorized employees
of a permittee shall be as follows: They shall backfill all material
and shall ram or tamp with a mechanical tamper each six inches of
replaced material. Tunneling will be allowed only on permission of
the Borough Manager. When the backfill is eight inches below and parallel
to the finished surface of the street, the excavation shall be covered
with a six-inch concrete slab extending nine inches beyond the original
opening, thus providing a bearing for the finished surface. The finished
surface material shall be to the specification prepared by the Borough
Engineer for the type of street being replaced; however, for all concrete
laid at temperatures between 40° and 50° F., 1% of calcium
chloride shall be added to the concrete mixture, and when the temperature
is lower than 44° F., 2% of calcium chloride shall be added. No
concrete shall be laid when the temperature is lower than 25°
F.
B.
If within two years after the restoration of the surface as herein
provided defects shall appear therein resulting from defective backfilling
by the permittee, the permittee shall reimburse the Borough for the
cost of all necessary repairs to the permanent paving.
C.
Any person who shall open or excavate any street in the Borough shall
thoroughly and completely refill the opening or excavation in conformity
with this section and in such a manner as to prevent any settling
thereafter and shall restore the surface to the same condition as
it was before the opening or excavation, and such restoration shall
be in accordance with the specifications of the Department of Transportation
of the Commonwealth of Pennsylvania, which are hereby adopted as specifications
of the Borough for restoration of surfaces of streets in the Borough.
As restored, the surface shall conform to the proper grade and be
of the same surface covering as the part of the thoroughfare immediately
adjoining the opening.

D.
Restoration to and replacement of all excavated streets and sidewalks
shall be performed by the applicant within 30 days after completion
of the initial work unless weather conditions prevent the completion
of permanent restoration, at the discretion of the Borough Manager.
In that case, the restoration and restoration shall be completed as
soon as the weather conditions permit such work to be performed. Restoration
and replacement of streets under this section shall be performed in
accordance with the most recent Pennsylvania Department of Transportation
standards. Restoration and replacement of pavement under this section
shall consist of at least an eight-inch-thick bituminous concrete
base course and a two-inch-thick wearing course, in accordance with
the most recent Pennsylvania Department of Transportation standards.
Additionally, edges of the excavation shall first be cut 12 inches,
and the edges shall be hot sealed with application of AC-20 bituminous
sealer after placement of the paving.

E.
When four or more openings, or one continuous opening, have been
made within 100 linear feet of pavement, the applicant shall complete
restoration and replacement as provided herein for the entire length
of the street between the ends of the furthest openings, extending
from the curbline into the street a distance one foot beyond the center
line of the street or one foot beyond the trench, whichever is greater.

F.
If the Borough Manager or the Borough Engineer finds that the paving
surfaces adjacent to the street excavation are damaged, or where a
number of cross trenches are laid in proximity to one another, or
where equipment used by an applicant causes damage to the street or
adjacent streets where the street excavation occurs, the Borough Manager
or the Borough Engineer may order the restoration and replacement
provided for herein to the damaged street from curbline to curbline.

Any person who shall be convicted of a violation of any of the
provisions of this article before any Magisterial District Judge shall
be sentenced to pay a maximum fine as provided from time to time by
state statute, together with costs of prosecution, or to imprisonment
in the county jail for a term not to exceed 30 days, or both.
