The location and planting of trees and shrubbery in the streets, highways, alleys and other public places in this City, and along the sidewalks of this City, shall in all cases be under the direction of the Street Commissioner and subject to the supervision and control of the Street and Alley Committee, and said trees and shrubbery shall be planted in the manner as designated by said Commissioner and the members of the Street and Alley Committee.

Nothing in Section 245.010 or this Section shall be construed as to prevent or prohibit property owners, who have been or may be permitted by the City, to build, and have, in consequence, constructed grass plots, parkings and terraces next to and between their sidewalks and the curb or street line, or to plant, set out or raise trees and shrubbery, in and within such grass plots, parkings and terraces, in such manner that the same shall in no way obstruct the free passage of the water, nor interfere with the drainage of the gutter, nor with the free and untrampled use of the street, alley, highway or sidewalk.

No person shall cut, hack or otherwise injure or deface any tree or shrubbery growing upon any street, alley, highway, public place or on private property in this City; provided, this Section shall not be construed to prohibit a citizen from dealing with his own private property in such manner as to him/her may seem best, or to prohibit any employee of this City or his authorized agent from trimming any tree or shrubbery upon or along side of any street, alley, highway or sidewalk of this City for the purpose of clearing the traveled portion of said street, alley, highway or sidewalk for the free use of the public.

Any person who shall allow or permit any tree, hedge, bush or shrubbery on his premises adjacent to any street, alley or sidewalk to encroach or extend over and onto any street, alley or sidewalk so as to interfere with or impede passage or traffic thereon, shall be deemed guilty of an ordinance violation.
