A. Effective
January 1, 1991, a fifty percent (50%) Pagedale tax rebate on electric
and natural gas utilities shall be provided to any qualified person,
who is either:
1. Sixty-two (62) years of age or older and retired; or
2. Totally disabled as defined by the Social Security Act as amended
and receiving benefits therefrom.
B. The
tax rebate shall be based upon the aggregate amount of all Pagedale
taxes on sales and charges for electricity and natural gas services,
less discounts, credits, penalties and refunds to an eligible City
resident.
C. Additional
criteria for eligibility may be determined by the Board of Alderpersons
from time to time; and the Board of Alderpersons shall retain the
right to limit and/or to terminate this program.
D. Qualified
residents during the entire calendar year for which any rebate is
sought must have been a single resident of or the head of household,
must have resided in the City as his/her primary place of residence
and must have been of the age of sixty-two (62) years.
E. Any
qualified persons seeking a rebate shall obtain a rebate application
from the City Hall. The rebate application shall request all necessary
information to validate eligibility, as well as such documentation
as may be required by the Board of Alderpersons. At the discretion
of the Board of Alderpersons, such proof may include, but not be limited
to, proof of age, residency or disability and original stubs of utility
bills and proof of payment of such bills.
F. Claims
for rebates shall be honored only if City real estate and personal
property taxes are fully paid by the resident claiming a rebate and
proof of same provided. Rebate applications may be submitted each
year between January first (1st) and April thirtieth (30th) of each
year for the preceding year.
G. Nothing
contained herein shall in any way alter or diminish the obligation
of any individual's obligation to pay fully and promptly any utility
tax.
H. Rebate
payments herein authorized shall be from the general revenue funds
of the City of Pagedale. The Board of Alderpersons shall appropriate
through the City's annual budget an amount equal to the projected
total of rebate payments.
I. Any
person who willfully provides misleading or fraudulent information
for purposes of obtaining a rebate for which he/she is ineligible
shall be guilty of a misdemeanor and upon conviction thereof shall
be fined not less than one hundred dollars ($100.00) nor more than
five hundred dollars ($500.00). In addition, upon conviction, any
rebate monies paid by the City of Pagedale to such person shall be
repaid to the City as restitution.
