This chapter is enacted to protect and promote the health, safety and welfare of the citizens of the Borough of Chesilhurst (the "Borough").
This chapter establishes definitions; controls and prohibits certain public health nuisances; declares certain acts, accumulations, violations and activities as public health nuisances; provides the procedure for abatement of public health nuisances, enforcement of this chapter, and recovery of costs incurred by the Borough.
The provisions of this chapter shall be enforced by the Health Officer, Registered Environmental Health Specialist or other enforcing officials employed by the Borough and/or the Camden County Health Department for inspection and enforcement. Enforcement shall be in the municipal court having jurisdiction over proceedings to enforce and collect any penalty imposed because of a violation of any provision of this chapter. The proceedings shall be summary and in accordance with the Penalty Enforcement Law (N.J.S.A. 2A:58-10 et seq.). Process shall be in the nature of a summons or warrant and shall be issued by those authorized by the local Board of Health.
A. 
Any person found guilty of a violation any provision of this chapter shall be liable for a penalty of $100 to $500 in accordance with N.J.S.A. 26:3-70.
B. 
Penalties shall be payable to the treasury of the Borough's governing body.
C. 
Except as otherwise provided, each and every day in which a violation of any provision of this chapter continues shall constitute a separate violation.
In the event that any section, sentence or clause of this chapter shall be deemed unconstitutional or invalid by a court of competent jurisdiction, such declaration shall not in any matter render void or prejudice the enforcement of the remaining sections of this chapter.
