This Chapter shall be known and may be cited hereinafter as "the Zoning Ordinance of the City of Dardenne Prairie".

A. 
Purpose. The purposes of this Chapter are to lessen congestion in the streets; to secure safety from fire, panic and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration of population; to preserve features of historical significance; to ensure environmental compatibility; and to facilitate the adequate provision of transportation, water, sewerage, schools, parks and other public requirements.
B. 
Basis — Final Report. The zoning regulations in this Chapter are based upon and are enacted in accordance with the final report of the Zoning Commission of the City of Dardenne Prairie which the Planning and Zoning Commission has made and presented to the Board of Aldermen after making a preliminary report and holding public hearings thereon in accordance with Section 89.070, RSMo. and other applicable Sections of Chapter 89, RSMo.
In its said final report, the Planning and Zoning Commission has recommended the establishment of various zoning districts and regulations for land use and development in the City of Dardenne Prairie.
Having conducted public hearings in accordance with Section 89.050, RSMo. and other applicable Sections of Chapter 89, RSMo. and having given reasonable consideration to the statements made and evidence adduced at said public hearings and to the recommendations of the final report of the Planning and Zoning Commission and to the character of the land, the existing land uses and the suitability for particular land uses of the land encompassed in the various zoning districts recommended by the Planning and Zoning Commission and with a view to conserving the values of buildings and encouraging the most appropriate use of land throughout the City of Dardenne Prairie, the Board of Aldermen of the City of Dardenne Prairie finds that the zoning districts and zoning regulations recommended in the final report of the Planning and Zoning Commission are appropriate, seasonable and necessary to accomplish the purposes of this Chapter and are designed to accomplish the purposes of this Chapter and the zoning districts and zoning regulations recommended in the final report are therefore enacted by the City of Dardenne Prairie as provided in the following Sections of this Chapter and the City of Dardenne Prairie hereby adopts this Chapter recommended in said final report as the zoning ordinance of the City of Dardenne Prairie as subsequently amended by ordinance and as revised herein.

The provisions of this Chapter shall apply to all uses, structures, improvements and alterations approved by the City after enactment of this Chapter.

All rights or remedies of the City are expressly saved to any and all violations of any previous zoning ordinance or amendments thereto of the City and that have accrued at the time of the effective date of this Chapter and such accrued violation of previous zoning ordinances which would otherwise become non-conforming under this Article shall be considered as violations of this Chapter in the same manner.

A. 
In interpreting and applying the provisions of this Chapter, they shall be held to be the minimum requirements for the promotion of the public health, safety, morals, comfort or general welfare. It is not intended by this Chapter to interfere with or abrogate or annul any easements, covenants or other agreements between parties or any Statute, local Chapter or regulation, except that if this Chapter imposes a greater restriction or higher standard, then this Chapter shall control.
B. 
If any Section, Subsection, sentence, clause or phrase of this Chapter is for any reason held to be invalid by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Chapter.
C. 
All ordinances or parts thereof in conflict with any of the provisions of this Chapter are hereby repealed insofar as the same are in conflict with the provisions hereof.

This Chapter shall be in force and effect from and after the day of its final passage and approval, June 21, 2001.
