It is determined and declared to be necessary and conducive
to the protection of the public health, safety, welfare, and convenience
of the City to collect charges from all users who contribute wastewater
to the City's sewer system. The proceeds of such charges so derived
will be used for the purpose of operating, maintaining, and retiring
the debt for such public sewer system.

Unless the context specifically indicates otherwise, the meaning
of terms used in this Chapter shall be as follows:
The quantity of oxygen utilized in the biochemical oxidation
of organic matter under standard laboratory procedure in five (5)
days at twenty degrees Celsius (20° C.), expressed in milligrams
per liter (mg/l).
Wastewater that has a BOD concentration of not more than two hundred (200) mg/l, a suspended solids concentration of not more than two hundred twenty (220) mg/l, and any other pollutant in concentrations defined in Chapter 710, or established by the City.
All expenditures during the useful life of the sewer system
for materials, labor, utilities, and other items which are necessary
for managing and maintaining the sewer system to achieve the capacity
and performance for which such system was designed and constructed.
Expenditures for obtaining and installing equipment, accessories,
or appurtenances which are necessary during the useful life of the
sewer system to maintain the capacity and performance for which such
works were designed and constructed. The term "operation and maintenance"
includes replacement.
Any contributor to the City's sewer system whose lot,
parcel of real estate, or building is used for domestic dwelling purposes
only.
Any devices and systems for the storage, treatment, recycling,
and reclamation of municipal sewage, domestic sewage, or liquid industrial
wastes. These include interceptor sewers, outfall sewers, sewage collection
systems, individual systems, pumping power, and other equipment and
their appurtenances; extensions improvement, remodeling, additions
and alterations thereof; elements essential to provide reliable recycled
supply such as standby treatment units and clear well facilities;
and any works, including site acquisition of the land that will be
an integral part of the treatment process or is used for ultimate
disposal of residues resulting from such treatment (including land
for composting sludge, temporary storage of such compost, and land
used for the storage of treated wastewater in land treatment systems
before land application); or any other method or system for preventing,
abating, storing, treating, separating, or disposing of municipal
waste or industrial waste, including waste in combined storm water
and sanitary sewer systems.
Solids that either float on the surface of or are in suspension
in water, sewage, or other liquids and which are removable by laboratory
filtering.
The estimated period [twenty (20) years] during which a sewer
system or equipment will be operated.
That portion of the total wastewater service charge which
is levied in a proportional and adequate manner for the cost of operation,
maintenance, and replacement of the sewer system or any portion thereof.
A water volume measuring and recording device, furnished
and/or installed by the City or furnished and/or installed by a user
and approved by the City.

A.Â
The purpose of this Chapter is to assure that the user charge system
shall generate adequate annual revenues to pay costs of annual operation,
maintenance, and replacement and the costs associated with debt retirement
of bonded capital associated with financing the sewer system which
the City may, by ordinance, designate to be paid by the user charge
rate. Funds (accounts) to accomplish this have been set by Bond Issue
Ordinance No. 2328, adopted June 1, 1993. This Sewer User Charge System
Ordinance further details the sewer user charge rates and gives illustrations
of how those rates were determined.
B.Â
That portion of the total user charge collected which is designated for operation, maintenance, and replacement purposes as established in Section 715.040, shall be deposited in a separate non-lapsing fund known as the "Operating, Maintenance, and Replacement Fund" and will be kept in two (2) primary accounts as follows:
1.Â
An account designated for the specific purpose of defraying
operation and maintenance costs, excluding replacement, of the sewer
system (Operation and Maintenance Account).
2.Â
An account designated for the specific purpose of ensuring replacement
needs over the useful life of the sewer system equipment (Depreciation
and Replacement Account). Deposits in the Replacement Account shall
be made at least annually from the operation, maintenance and replacement
revenue in the amount of twenty-six thousand dollars ($26,000.00)
annually. (Reference is made to Appendix B, which is on file in the
City offices.)
C.Â
Fiscal year-end balances in the Operation and Maintenance Account
and the Replacement Account shall be carried over to the same accounts
in the subsequent fiscal year, and shall be used for no other purposes
than those designated for these accounts. Monies which have been transferred
from other sources to meet temporary shortages in the Operation, Maintenance,
and Replacement Funds shall be returned to their respective accounts
upon appropriate adjustment of the user charge rates for operation,
maintenance and replacement. The user charge rate(s) shall be adjusted
such that the transferred monies will be returned to their respective
accounts within the fiscal year following the fiscal year in which
the monies were borrowed.

For residential contributors, monthly sewer user charges will be
based on water used during the current month as determined by water
meter(s) acceptable to the City.
B.Â
For industrial and commercial contributors, sewer user charges shall
be based on water used during the current month as determined by water
meter(s) acceptable to the City. If a commercial or industrial contributor
has a consumptive use of water, or in some other manner uses water
which is not returned to the wastewater collection system, the user
charge for that contributor may be based on a wastewater meter(s)
or separate water meter(s) installed and maintained at the contributor's
expense and in a manner acceptable to the City; however, separate
meters for lawn sprinkling are not allowable.

For users residing within the City limits of Kennett, Missouri, the
minimum sewer charge per month for the first one thousand (1,000)
gallons of water used shall be one dollar and sixty-six cents ($1.66)
for a five-eighths-inch meter and two dollars and forty-one cents
($2.41) for a one-inch water meter. In addition, each contributor
shall pay a user charge rate of eighty-six cents ($0.86) per each
one thousand (1,000) gallons of water (or wastewater) used (or contributed)
over one thousand (1,000) gallons for operation, maintenance, replacement,
debt retirement, and other miscellaneous expenses as determined in
the preceding Section. The maximum monthly sewer charge assessed to
any single-family residential contributor shall be one hundred dollars
($100.00).
D.Â
For sewer users who obtain water partially or wholly from a source other than the City water system, then said user shall pay the same rates as set forth in Section 715.040(C). In the absence of a water meter, the amount of water used shall be estimated by the Utilities Superintendent of the Kennett Board of Public Works. The water use estimate shall be reviewed at least annually, or more often if the City so decides, by the Utilities Superintendent of the Kennett Board of Public Works, or his/her representative, and modified as necessary.
E.Â
For sewer users residing outside the City limits of Kennett, Missouri, a flat rate may be charged in addition to the rates set forth in Section 715.040(C). The amount of the additional flat charge shall be determined and recommended by the Utilities Superintendent of the Kennett Board of Public Works. The flat rate shall be reviewed at least annually, or more often if the City so decides, by the Utilities Superintendent of the Kennett Board of Public Works, or his/her representative, and modified as necessary.

For those contributors who contribute wastewater, the strength of
which is greater than normal domestic sewage, a surcharge in addition
to the normal user charge will be collected. The surcharges for operation,
maintenance, and replacement are:

Any user discharging, or proposing to discharge, any toxic pollutant(s)
that will, or could, increase the cost of managing the effluent or
the sludge from the City's sewer system, or any user discharging
any substance which singly or by interaction with other substances
causes identifiable increases in the cost of operation, maintenance,
or replacement of the sewer system, shall pay for such increased costs.
The charge to each such user shall be determined by the Utilities
Superintendent of the Kennett Board of Public Works, or his/her representative,
and modified as necessary.
H.Â
The quantity of water used on premises furnished with sewer services
by the City shall be measured by the water meter or water meters serving
the premises. The Utilities Superintendent of the Kennett Board of
Public Works, or his/her representative, shall have access to the
premises of the user at all reasonable times for the purpose of reading,
inspecting, or testing said water meter or meters.
I.Â
Each user reading at or who occupies a residence, industry, or commercial
establishment where City sewer is furnished during any part of a month
shall be liable for the monthly minimum charge as established in this
Section and as it may be revised from time to time.

All users shall be billed monthly.
B.Â
A late payment penalty will be added to each delinquent bill in accordance
with the rules and regulations of the Kennett Board of Public Works.
Service may be discontinued until such bill is paid. A reconnect fee
may be charged by the City to reinstall the water and/or sewer service.
C.Â
The person to whom water and/or sewer service is supplied shall be
liable for the payment of the water and/or sewer bill.

A.Â
The City will review this user charge system at least every two (2)
years and revise the user charge rates as necessary to ensure that
the system generates adequate revenues to pay the costs of operation,
maintenance, and replacement of any component of the sewer system.
During that review, the City will also ensure that the user charge
rates continue to provide for the proportional distribution of operation,
maintenance, and replacement costs among users and user classes.
B.Â
The City will notify each user at least annually, along with a regular
bill, of the rate being charged for operation, maintenance, and replacement
of the sewer system.
