The proposed waterworks and the proposed sewerage system of the City of Leadwood, Missouri, and all future improvements and extensions thereto, whether to the waterworks or to the sewerage system or to both, shall be and the same are hereby combined and thenceforth shall be operated and maintained as a combined waterworks and sewerage system.

All residents and property owners within the City limits of Leadwood shall be hooked up to the water utility.

The sewer charge for water and wastewater shall be based on the flat rate bill classification. The following water and wastewater rates will be in effect as of January 1, 2022:

Application for water and sewerage services shall be made to the City Clerk or other person designated by the Board of Aldermen by the owner or occupant of the property to be served and upon the approval of such application, such applicant shall have the right to connect with the City's combined waterworks and sewerage system, all costs of such connection to be borne by such applicant. The Board of Aldermen hereby sets a meter deposit charge of seventy-five dollars ($75.00).

A. 
Service Charge For New Connection. The minimum service charge for a new connection is a fee of three hundred fifty dollars ($350.00) provided rock does not exist in the area of connection. If the City determines there is an unusual amount of rock present that requires removal, the property owner shall pay the City fifty dollars ($50.00) per hour for all time expended plus any other out of pocket expenses related to the new connection work.
B. 
Security Deposit. If a new water customer, the property owner shall further pay to the City a security deposit fee of one hundred fifty dollars ($150.00). A deposit fee of one hundred fifty dollars ($150.00) shall also be paid by the property owner if the user in the past had water service terminated for non-payment of the water utility bill. The one hundred fifty dollar ($150.00) deposit shall be returned to the property owner after experiencing two (2) years of payments without a delinquency of more than ten (10) days from the date the water bill was due. If water services are terminated for non-payment, the security deposit of one hundred fifty dollars ($150.00) shall be applied to the user's unpaid utility balance and, if a surplus, those funds will be returned to the property owner.

The Governing Body of the City of Leadwood, Missouri, hereby finds and determines that the rates, fees and charges for the use and services of the combined waterworks and sewerage system of the City necessary and adequate at this time to meet the requirements of Sections 250.010 to 250.250, inclusive, RSMo., are as hereinbefore specified.

All water meters shall be read and bills for water and sewerage services shall be rendered monthly as such services accrue. The Water Clerk or other officer or representative of the City designated to prepare and render bills for water and sewerage services shall calculate monthly the amount of each bill for water service and shall add thereto the amount of such customers bill for sewerage service and shall render monthly to each customer a combined bill for such water and sewerage services. All such bills shall be due and payable at the office of the City Collector during the regular hours of business from and after the date of the rendition thereof.

Water utility bills will be issued within five (5) days from the close of the period for which the water service was provided for that given period in accordance with the water rate schedule. Water utility bills not paid to the City within ten (10) days of the date of the bill shall be subject to a five percent (5%) late charge (i.e., 5% times the amount of the unpaid water bill). Failure of the City to submit a water bill to the property owner or user shall not excuse the property owner or user from paying the water bill. If the property owner or user does not pay the water bill in full by the thirtieth (30th) day following the close of the period for which water service was provided, this shall result in the termination and disconnect of the water service without any form of notice to the property owner or user.

A. 
If any bill for water and sewerage services or for either water service or sewerage service (if any customer shall receive one (1) of such services but not both) shall be and remain past due and unpaid for as long as thirty (30) days, service to such customer shall be discontinued and shall not be reconnected until all past due bills are paid in full, together with a reconnection fee as set out below. It shall be the duty of the City Collector to notify the Board of Aldermen of any such delinquency and said Board shall proceed immediately to cause water service to such customer to be discontinued.
B. 
The reconnection fee is fifty dollars ($50.00) if the property owner had water service terminated and shut off for non-payment of the water bill. In addition to the fifty dollar ($50.00) reconnection fee, in order to have water service restored, the property owner shall pay the unpaid water bill in full and an additional security deposit of one hundred fifty dollars ($150.00) if the City does not have an existing deposit shown on the City records.

The occupant and user of the premises receiving water and sewerage services or either of them and the owner of said premises shall be jointly and severally liable to pay for such services rendered on said premises. The City shall have power to sue the occupant or the owner, or both, of such real estate in a civil action to receive any sums due for such services, plus a reasonable attorney's fee to be fixed by the court.

Water service shall be supplied only through water meters installed and meeting the City's specifications and only one (1) connection shall be permitted to each water meter. No free water service or sewerage service shall be furnished to any premises or the owner or occupant thereof, except to the City itself, and in the event that the revenues derived by the City from its combined waterworks and sewerage system shall at any time prove insufficient to pay the cost of maintenance and operation thereof and to pay the interest on and principal of the combined waterworks and sewerage system revenue bonds of the City issued to construct, extend or improve such system or any part thereof, and to establish and maintain reasonable reserves as provided in the ordinance authorizing the issuance of such bonds, then the City will thereafter pay a fair and reasonable charge for all water and sewerage services or water service or sewerage service furnished the City or any of its departments by the combined waterworks and sewerage system and such payments will continue so long as the same may be necessary in order to prevent any default in the payment of the interest on or principal of the combined waterworks and sewerage system revenue bonds of the City or while any such default shall exist.

It shall be a misdemeanor for any person or persons to tamper with any water main, water meter or sewer line or to make any connection to the combined waterworks and sewerage system of the City without written permission from the City or to reconnect service when service has been discontinued for non-payment of a bill for service until such bill, including the reconnection charge, has been paid in full.
