The duties of the City Clerk under this chapter shall be as follows:
A. 
Accepting the filing of a preliminary or final plat application.
B. 
Distribution of appropriate copies to state, county, and local agencies per Chapter 236, Wisconsin Statutes.
C. 
Providing written notice to the applicant of the action of the Common Council.
The powers and duties of the Department of Community Development under this chapter shall be as follows:
A. 
Pre-application conference and voluntary sketch plan.
(1) 
Hold pre-application conference with applicant.
(2) 
Review completeness of voluntary sketch plan application.
(3) 
Make recommendation to the Plan Commission.
B. 
Preliminary plat.
(1) 
Review completeness of preliminary plat application.
(2) 
Make recommendation to the Plan Commission.
C. 
Plat compliance review.
(1) 
Review plans and specifications for all proposed new, modified, or extension of existing public improvements.
(2) 
Review plans and specifications for all proposed new or modified private improvements.
(3) 
Coordinate review and approval of all plans with other local, state, and federal regulatory agencies.
D. 
Development agreement.
(1) 
Work with applicant on drafting a development agreement and all necessary components of this agreement.
(2) 
Review the development agreement and report findings to the Board of Public Works.
E. 
Final plat.
(1) 
Review completeness of final plat application.
(2) 
Deny issuance of zoning, building, or occupancy permit in cases where the final plat is not approved.
(3) 
Make recommendation to the Plan Commission.
The powers and duties of the Plan Commission under § 62.23, Wis. Stats., and this chapter shall be to hold public meetings to review and make recommendations to the Common Council to approve or deny such applications.
A. 
Plans and specifications. To superintend all plan standards and specifications; review of the City Engineer's reports of any proposed plans and specifications or any new, modified, or extension of existing public improvements.
B. 
Development agreements. The powers and duties of the Board of Public Works under § 62.14, Wis. Stats., and this chapter shall be to hold public meetings to review and make recommendations to the Common Council to approve and/or deny development agreements.
The powers and duties of the Common Council under this chapter shall be as follows:
A. 
Certified Survey Map. After review and recommendation from the Plan Commission, the Common Council shall hold a public meeting or direct the Plan Commission to hold a public meeting to review and take final action to approve, conditionally approve or deny such certified survey maps.
B. 
Preliminary plat. After review and recommendation from the Plan Commission, the Common Council shall hold a public meeting or direct the Plan Commission to hold a public meeting to review and take final action to approve, conditionally approve, or deny such plats.
C. 
Development agreement. After review and recommendation from the Department of Community Development and the Board of Public Works, the Common Council shall hold public meetings to review and take final action to approve, approve with conditions, or deny such agreement.
D. 
Acceptance of improvements. The Director shall review and recommend to the Common Council acceptance of public improvements based upon opinion of compliance. The Common Council may accept dedication of public improvement after hearing the Director's recommendation regarding same.
E. 
Final plat.
(1) 
After review and recommendation from the Plan Commission, the Common Council shall hold public meetings to review and take final action to approve or deny such plats.
(2) 
Refuse to accept dedication of land in lieu of payment of public site, open space, and trail fees that have not been certified by the Director's to meet the minimum requirements set forth in this chapter and in the City of New Berlin Developer's Handbook.
(3) 
Acceptance of dedication of land for public infrastructure pursuant to § 236.29, Wis. Stats.
No building permit shall be issued until the final plat has been approved and recorded and all public improvements are accepted by the Department of Community Development.
