In order to classify and regulate the location of businesses,
trades, industries, residences and other land uses and the location
of buildings designed for specific uses, to regulate and limit the
height and bulk of buildings hereafter erected, reconstructed or altered,
to regulate and limit the intensity of the use of lot areas and to
regulate and determine the area of yards, courts and other open spaces
within and surrounding such buildings, the incorporated area of the
City of Willow Springs, Missouri, is hereby divided into nine (9)
districts as follows:

The Zoning District Map, which is on file in the City offices, attached to this Chapter showing the nine (9) zoning districts listed in Section
405.030 is hereby adopted as the official Zoning District Map of the City of Willow Springs, Missouri.

A. Where
uncertainty exists with respect to the boundaries of any of the aforesaid
districts as shown on the Zoning District Map, the following rules
shall apply.
1. Where district boundaries are indicated as approximately following
the centerlines of streets or highways, street lines or highway right-of-way
lines, such centerlines, street lines or highway right-of-way lines
shall be construed to be such boundaries.
2. Where district boundaries are so indicated that they approximately
follow the lot lines, such lot lines shall be construed to be said
boundaries.
3. Where district boundaries are so indicated that they are approximately
parallel to the centerlines or street lines of streets or the centerlines
or right-of-way lines of highways, such district boundaries shall
be construed as being parallel thereto and at such distance therefrom
as indicated on the Zoning District Map. If no distance is given,
such dimension shall be determined by the use of the scale shown on
the Zoning District Map.
4. Where the boundary of a district follows a railroad line, such boundary
shall be deemed to be located in the middle of the main tracks of
said railroad line.
5. Where the boundary of a district follows a stream, lake or other
body of water, the boundary shall be the limit of the jurisdiction
of the City, unless otherwise indicated.

Whenever any street, alley, public way, railroad right-of-way,
waterway or other similar area is vacated by proper authority, the
districts adjoining each side of such street, alley, public way, railroad
right-of-way or similar area shall be extended automatically to the
center of such vacation and all area included in the vacation shall
then and thenceforth be subject to all appropriate regulations of
the extended districts. In the event of a partial vacation, the adjoining
district or districts nearest the portion vacated shall be extended
automatically to include all the vacated area.

A. Except
as hereinafter provided:
1. No building or land shall be used or occupied and no building or
part thereof shall be erected, moved or altered unless in conformity
with the regulations specified for the district in which it is located.
2. No building shall be erected or altered:
b. To accommodate or house a greater number of families;
c. To occupy a greater percentage of lot area; or
d. To have a narrower or smaller rear yard, front yard, side yard, inner
or outer court than is specified for the district in which such building
is to be located.
3. No part of a yard or other open space about any building required
for the purpose of complying with the provisions of the standards
in this Chapter shall be included as a part of a yard or other open
space similarly required for another building.
4. When parcels of land outside of the municipal boundary are annexed
into the City, the Planning and Zoning Commission shall recommend
appropriate zoning districts to the Board of Aldermen, which shall
make the final determination of the appropriate zoning districts at
the time of annexation.
