Unless the context clearly indicates otherwise, the meanings
of the terms and phrases used in this chapter shall be as follows:
An antenna, together with all attachments and parts thereof,
used to receive television signals from orbiting satellites. Parabolic
antenna(s) and satellite dishes are included in this definition.
A.
Nothing contained in this chapter shall be interpreted or applied
in a manner that impairs a person's ability to install, maintain
or use a satellite dish antenna(s) within the border of the Borough
of Collingdale. A restriction impairs if it: (1) unreasonably delays
or prevents use of; (2) unreasonably increases the cost of; or (3)
precludes a person from receiving or transmitting an acceptable quality
signal from an antenna covered by the rule.
B.
This chapter applies to:
(1)
Satellite dish antenna(s) that are one meter or less in diameter
and designated to receive direct broadcast satellite services, including
direct-to-home satellite service or to receive or transmit fixed wireless
signals via satellite;
(2)
An antenna that is one meter or less in diameter or diagonal measurement
and is designed to receive video programming services via broadband
radio service (wireless cable) or to receive or transmit fixed wireless
signals other than via satellite;
(3)
An antenna that is designated to receive local television broadcast
signals.
A.
Satellite dish antenna(s) shall be permitted in all zoning areas.
B.
Satellite dish antenna(s) may be roof-mounted, wall-mounted or ground-based,
subject to the provisions of this chapter.
C.
The maximum diameter of a satellite dish antenna shall not exceed
one meter.
D.
All satellite dish antenna(s) shall be mounted in a safe and stable
manner to prevent damage or injury and for safety purposes shall be
adequately grounded, with all wiring for ground-based dish antenna(s)
to be placed below ground level.
E.
The installation of all satellite dish antenna(s) shall be in accordance
with all applicable federal, state or local laws, codes and regulations.
A.
When locating and installing a satellite dish antenna(s) the following
provisions shall be followed:
(1)
The placement, installation and maintenance by a property owner and/or
tenant of any property within the Borough shall be on the rear roof,
rear facade or rear yard of the property unless this would cause a
material reduction in signal reception.
(2)
If the rear roof, rear facade or rear yard is not available for placement
of a satellite dish antenna(s), the property owner and/or tenant in
a one-family or multifamily dwelling shall place, install and maintain
the satellite dish antenna(s) in an alternate location on the roof,
side yard or facade of the building, making every effort to avoid
placement on the front of the property.
(3)
No property owner or tenant shall place, install or maintain, or
allow to be placed, installed or maintained a satellite dish antenna(s)
on the front roof, facade or yard of a property unless he can establish
that all other placements would create a material reduction in signal
reception or such alternate sites would result in the significant
additional cost to the property owner or tenant. Prior to installation,
the owner or tenant shall provide the Borough Manager for the Borough
of Collingdale sufficient written information for the Borough to make
a fair determination warranting the placement of the satellite dish
antenna(s) on the front of the property.
B.
Roof-mounted antenna(s) which are capable of receiving or transmitting
an acceptable quality signal shall be installed at a height no higher
than the roofline for slope roofs nor more than four feet above the
highest point of a flat roof.
C.
Where a roof-mounted satellite dish antenna can receive or transmit
an acceptable quality of signal, the placement, installation and maintenance
of said dish shall be on that part of the roof that slopes away from
the front facade of the building. All roof-mounted satellite dishes
shall be placed, installed and maintained in such a manner as to minimize
their visual impact on neighboring properties.
All property owners and/or tenants shall be responsible for
the proper removal and disposal of any satellite dish antenna(s) within
10 days of termination of service and/or before replacing or installing
a new satellite dish or antenna(s) on any lot, dwelling or multidwelling
property within the Borough of Collingdale.
Prior to the installation or placement of a satellite dish antenna(s),
the property owner, tenant or installer must provide the Collingdale
Borough Manager with three days' prior written notice of his intention
to install and/or place a permitted satellite dish antenna(s), providing
the name and address of the installer, property address and approximate
location of the intended installation.
