The Chief of Police shall be appointed by the Mayor and approved by a majority of the members of the Board of Aldermen for an indefinite period of time, and his/her tenure of office shall depend upon the will of the Board of Aldermen. The Chief of Police shall be technically qualified by training and experience and shall have the ability to command men and hold their respect and confidence. He/she may be removed at the will of the Mayor and Board of Aldermen.

A. 
The Chief of Police and Police Officers shall have the following powers and duties:

The Chief of Police shall have such powers and perform such duties as required of the Chief of Police or Marshal by law.
2. 
The Chief of Police shall, in the discharge of his/her duty, be subject to the orders of the Mayor only. The Police Officers shall, in the discharge of their duties, be subject to the orders of the Mayor and Chief of Police only.
3. 
The Chief of Police and Police Officers shall have power to serve and execute all warrants, subpoenas, writs or other process issued by the Municipal Judge of the City at any place within the limits of the County.
4. 
The Chief of Police and all Police Officers of the City shall be conservators of the peace and shall be active and vigilant in the preservation of good order within the City.
5. 
The Chief of Police and all Police Officers shall execute all orders and serve all notices emanating from the Mayor or the Board of Aldermen.
6. 
It shall be the duty of the Chief of Police and every Police Officer to be active and vigilant in enforcing this Code or other ordinances in relation to nuisances, misdemeanors and the public peace and good order; and to arrest without process and to take before the Municipal Judge for trial any person who shall within the City in their presence commit any violation of such Code or ordinance or of the criminal laws of the State. The Chief of Police and every Police Officer may enter any disreputable place or into any business house or residence within the City limits for the purpose of preventing or suppressing any disorderly or riotous conduct of any person therein and may arrest such persons and take them before the Municipal Judge for trial. If such arrest is made in the nighttime, such persons may be incarcerated in the Christian County Detention Center until such time as the Municipal Judge shall be in his/her office, when they shall be taken before him/her for trial.

The Chief of Police shall at all times perform such duties as are, or shall be, enjoined on him/her by this Code or other ordinance or resolution of the Board of Aldermen or any Statute of the State.

It shall be the duty of the Chief of Police to visit all suspicious or disorderly neighborhoods or houses and all parts of the City where disorder and breaches of the law are most likely to be committed and to arrest and take into custody, without warrant, any person who may be found in the commission of an offense against this Code or other ordinance of the City and report such arrest to the City Attorney.
9. 
It shall be the duty of the Chief of Police to attend in person, or appoint one (1) of the City Police Officers to attend, the Board of Aldermen's meetings when in session.
10. 
The Chief of Police shall collect and preserve all personal property belonging to the City, whenever such property is not in lawful possession of some person employed in the services of the City.
11. 
Every Police Officer shall obey all rules and regulations prescribed by the Mayor and the Chief of Police.
12. 
No Police Officer or other person in the employ of this City as such, making an arrest, shall be allowed to take from the party arrested any money or other property except weapons, until such party arrested shall be taken before the Chief of Police or Municipal Judge or some other responsible person where a search of the person arrested shall be made and a list of his/her property made in a book kept by the Police for such purpose and attested by the officer or person before whom the search was made.
13. 
It shall be the duty of every Police Officer to take every person arrested by him/her before the Municipal Judge for trial, and he/she shall not in any case take any person before any other officer for trial unless under the direction of the Municipal Judge or the Mayor.
14. 
The Chief of Police shall perform all duties specified to be performed by a Marshal.
15. 
It shall be the duty of the Chief of Police and all Police Officers to enforce all traffic regulations of this Code or other ordinance relating thereto and all of the State vehicle laws applicable to street traffic in the City.
16. 
It shall be the duty of the Chief of Police to be on call twenty-four (24) hours each day and that his/her active duty shall be as determined from time to time by the Board of Aldermen.
