As used in this Article, the following terms shall have these prescribed meanings:
ABANDONED MOTOR VEHICLE
A motor vehicle that is in a state of disrepair and incapable of being removed under its own power.
AUTOMOBILE GRAVEYARD
Any establishment, area or place of business maintained, used or operated for storing, keeping, buying or selling wrecked, scrapped, ruined or dismantled motor vehicles or any parts thereof.
JUNK
Old or scrapped copper, brass, ropes, rags, batteries, paper, trash, rubber debris, waste or junked, dismantled or wrecked automobiles, or parts thereof, iron, steel or other ferrous or nonferrous material.
JUNK YARDS
An establishment, area or place of business maintained, operated or used for the storing, keeping, buying, or selling of junk or for the operation of an automobile graveyard, garbage dump or sanitary fill.

No person shall operate, establish or maintain a junk yard without having obtained a license from the City Collector.

No license shall be issued to any person to operate, establish or maintain a junk yard, except in an industrial zone, and no license shall be issued to any person or business unless the property or location of such junk yard is totally screened so as to render such junk yard not visible from the traveled way of any City street; provided however, that, this Section shall not authorize the establishment of automobile junk yards in areas not permitted by the Zoning Code.

The City Code Enforcement Officer and/or the County Health Department shall be the authorized representative of the City and a certificate from either officer or agency shall be required prior to any license being issued. Such certificate shall certify that the property is properly zoned industrial and shall certify that such property is properly fenced or screened.

All junk yards within the City shall be screened so as to render them not visible from the traveled way of any City street. The screening shall consist of a solid fence or wall made of tin or plastic or other material that extends from the ground a height of eight (8) feet, which shall be solid and shall totally make such junk yard not visible from the traveled way of any City street. The fence or screen shall be maintained in good repair.

No owner or occupant shall operate, establish or maintain a junk yard within a residential area or utilize the premises of any residential property for the open storage of any abandoned motor vehicles, ice box, refrigerator, stove, glass, building material, building rubbish or other junk. It shall be the duty and responsibility of every owner or occupant to keep the premises clean and to remove from the premises all such abandoned items as listed above, including but not limited to weeds, dead trees, trash, garbage and all other junk.
