The City hereby declares that its waterworks and its sewerage
systems shall hereafter be operated and maintained as a combined waterworks
and sewerage system. The combined system shall include all future
improvements or extensions, whether to the waterworks or to the sewerage
system or to both. The combined water and sewerage system shall be
operated under the Water and Wastewater Department.

A.
Position Created. There is hereby created the position of
Water and Wastewater Department Manager.
B.
Appointment. The Mayor shall appoint the Superintendent
of the Water Treatment Plant with the advice and consent of the City
Council.
C.
Qualifications. The person appointed department manager
of the Water and Wastewater Department shall have such qualifications
as set by the City Council from time to time.
D.
Duties. The Water and Wastewater Department Manager shall
have the following principal duties:
1.
Office management. The manager shall ensure the
efficient operation of the water and wastewater business office. The
manager shall have direct supervisory authority over the bookkeeper
of the City Water and Sewer Department, including oversight of the
bookkeeper's work.
2.
Management of the water distribution and wastewater collection
systems. The department manager shall have direct supervisory
authority over the Water Distribution and Wastewater Collection Chief.
The manager shall be responsible for the efficient operation of the
water distribution and wastewater collection systems.
3.
Assignment of personnel. The department manager
shall be responsible for the assignment of all service personnel within
the department. Requests for the assignment of personnel by the Superintendent
of the Water Treatment Plant, the Superintendent of the Wastewater
Treatment Plant and the Water Distribution and Wastewater Collection
Chief shall be made to the department manager who shall prioritize
the requests and assign the personnel accordingly.
4.
Reports. The department manager shall be responsible
for the preparation and filing of all reports of the Water and Wastewater
Department, excepting those of a technical nature to be filed by either
the superintendent of the water treatment plant or wastewater treatment
plant.
5.
Budget preparation and administration. The department
manager shall be responsible for the preparation of a budget within
the parameters established by the City Council, Finance Committee
and Mayor. Once the budget is adopted, the department manager shall
be responsible for operation of the department within the confines
of the budget.
6.
Purchasing/procurement. The department manager shall
be responsible for the procurement and purchasing of all equipment,
supplies, tools and services utilized by the department.
7.
Inventory control. The department manager shall
be responsible for control of all assets within the department.
8.
Public relations. The department manager shall insure
that efficient and courteous service is provided to the citizens of
the City. He or she shall be responsible for all public relations
operations of the department, including the receipt of complaints
and the department's response to the complaints.
9.
Miscellaneous. Such other duties as set forth in
this Code or as may be assigned by the Mayor and City Council from
time to time.

B.
Appointment. The Mayor shall appoint the Superintendent
of the Water Treatment Plant with the advice and consent of the City
Council.
C.
Qualifications. The person appointed as Superintendent of
the Water Treatment Plant shall have such qualifications as set by
the City Council from time to time. Such person shall, within six
(6) months of appointment to such position, hold all licenses and
certifications necessary to operate the water treatment plant.
D.
Duties. The Superintendent of the Water Treatment Plant
shall have the principal duty of operating, maintaining, protecting
and keeping in repair and good working order the water pumps and water
treatment plant. The Superintendent shall perform all necessary sampling
and testing as is required to insure a safe and wholesome water supply
for the City. The Superintendent shall prepare and submit all required
technical reports to the Department of Natural Resources relative
to the operation of the water system. The Superintendent of the Water
Treatment Plant shall have supervisory authority over all personnel
as may be assigned from time to time to the Water Treatment Plant
by the Water and Wastewater Department Manager.

six (6) months of appointment to such position, hold all licenses
and certifications necessary to operate the wastewater treatment plant.
D.
Duties. The Superintendent of the Wastewater Treatment Plant
shall have the principal duty of operating, maintaining, protecting
and keeping in repair and good working order the wastewater treatment
plant. The Superintendent shall perform all necessary sampling and
testing as is required to insure a safe and effective treatment of
wastewater collected and discharged by the City. The Superintendent
shall prepare and submit all required technical reports to the Department
of Natural Resources relative to the operation of the Wastewater Treatment
System. The Superintendent of the Wastewater Treatment Plant shall
have supervisory authority over all personnel assigned from time to
time to the Wastewater Treatment Plant by the Water and Wastewater
Department Manager.

Water Distribution and Wastewater Collection Chief.
B.
Appointment. The Mayor shall appoint the Water Distribution
and Wastewater Collection Chief with the advice and consent of the
City Council.
C.
Qualifications. The person appointed as Water Distribution
and Wastewater Collection Chief shall have such qualifications as
set by the City Council from time to time.
D.
Duties. The Water Distribution and Wastewater Collection
Chief shall have the principal duty of operating, maintaining and
keeping in repair and good working order all water lines, water meters,
wastewater collection and transport lines and wastewater lift stations.
These duties include the establishment of new water and wastewater
taps. The Water Distribution Chief shall supervise and assist in the
reading of the City water meters on a monthly basis. The Chief shall
also supervise the termination of water service as directed by the
water and wastewater office staff. As needed, the Chief may be assigned
to work under the supervision and at the direction of either the Superintendent
of the Water Treatment Plant or the Wastewater Treatment Plant.

A.
Position Created. There is hereby created the position of
bookkeeper of the City Water and Wastewater Department.
B.
Appointment. The Mayor shall appoint the bookkeeper of the
City Water and Wastewater Department with the advice and consent of
the City Council.
C.
Qualifications. The person appointed as bookkeeper of the
City Water and Wastewater Department shall have such qualifications
as set by the City Council from time to time.
D.
Bond. Before entering upon the discharge of his/her duties,
the bookkeeper shall execute to the City a good and sufficient bond
in the sum of fifty thousand dollars ($50,000.00), with good and sufficient
security, conditioned for the faithful performance of the duties of
his/her office and that he/she will account for and promptly pay over
all the monies coming to his/her possession that belong to the City
at the time and in the manner provided by law and the ordinances of
the City. The bond shall be approved by the Mayor and filed in the
office of the City Clerk.
E.
Duties. The bookkeeper shall carefully and accurately keep
all books and accounts of the City Water and Wastewater Department
and shall also be charged with the duty of collecting all rents and
other revenues due to the City for water or other service rendered
by the City by and through the combined City water and wastewater
system. It shall be his/her duty to punctually and honestly account
for all such funds so collected. The bookkeeper shall immediately,
and as collected, turn over and deliver to the City Treasurer the
money so collected and shall, before the second (2nd) regular meeting
of the Council in each calendar month, take a receipt from the City
Treasurer of all monies so collected and turned over during the previous
calendar month, a duplicate copy of which receipt, together with a
full and complete statement and report of collections made, shall
be presented to the Council at the second (2nd) regular meeting in
each calendar month, showing the amounts so collected and turned over
to the City Treasurer during the previous calendar month. He/she shall
also report to the Water and Wastewater Department Manager delinquencies
in payment of such rents immediately after they occur.

A.
Each
person or business requesting water and sewer service shall pay a
deposit of one hundred dollars ($100.00) for connection to a water
meter, which deposit shall be held by the City to secure payment of
all City fees and use charges for the customer's account, including
the fees and use charges and fees for water, sewer and solid waste
service. Upon discontinuation of service, said deposit shall first
(1st) be applied against any unpaid balance due on the customer's
account, with the balance of said deposit to be refunded to the customer
without interest.
B.
All
users of water shall be assessed and charged a meter service charge
of thirty-five cents ($0.35) per month.
C.
Meter Rates.

1.
The meter rates and charges for the City water shall be as follows:
For the first 2,000 gallons or less per month: $8.75.
For each additional 1,000 gallons over 2,000 gallons per month:
$6.00.
2.
Meter transfers. When a water meter is moved from
one location to another for the same user there shall be a fee of
ten dollars ($10.00) due and payable prior to the transfer.
D.
If
a meter fails at any time to register, the quantity of water shall
be determined by the readings of the meter during the three (3) months
preceding the time for which each failure to register occurs and a
bill rendered for the average thus found.
E.
Any
user of City water who has not paid his/her bill in full by the tenth
(10th) day of the month such bill is due shall be assessed a penalty
of twenty dollars ($20.00).
F.
Any
user of City water who has not paid his/her bill together with penalty
by the fifteenth (15th) day of any month shall have his/her water
service disconnected. Service shall be reconnected upon the payment
of the water bill together with penalties and a fifty dollar ($50.00)
charge for reconnection.
G.
Sewage
Rates. The following rates and charges for the use and services of
the sewage system of the City of Caruthersville shall be based on
the amount of water received each month by each premises for the City
waterworks system, as determined by water meter readings. The following
user charges are hereby established for the sewage system, to wit:

H.
Charges
for sewage service shall be made and collected against each water
user by said charge being calculated based on the above water consumption
and at the above rates and shall be billed on each user's water bill.
No free service shall be rendered to any user of the sewage system,
nor shall any user pay less than the charge or charges provided by
this Section. In addition to the above charges, a surcharge of twenty-five
dollars ($25.00) shall be made and collected against any user of the
City sewer system who reports a problem with the City sewer system
at any time other than during the City's regular business hours if
the problem is in the private sewer lines and there is in fact no
problem with the City's sewer system.
I.
Bills
for the rates and charges herein established shall be made out by
the Water Department of said City of Caruthersville and shall be sent
out monthly. The sewage use charge shall become a part of the water
bill and shall be paid in accordance with the provisions of the ordinances
establishing the water bills, penalties and other charges. The bills
shall be payable on the first (1st) day of each month following the
reading of the water meters and all bills shall be payable at the
office of the Water Collector of the City of Caruthersville.
J.
The
City Council shall review annually the rates charged for water, sewer
and garbage services in the City of Caruthersville, Missouri.
K.
The
rates and charges for water and sewer taps and street breaks shall
be such amounts as set by the Council from time to time.

The rates and charges, including the base rate and all incremental rates set by Section 700.030 for water service and sewer service shall be increased by two and one-half percent (2.5%) annually without further action, commencing on October 1, 2021, and on October 1 of each year thereafter in order to adjust for inflation. The Water and Wastewater Committee of the City Council shall annually review the increased rates so charged for water and sewer service, recommending to the City Council adjustments thereto by ordinance as may be necessary to meet the needs of the combined water and wastewater system. The adjusted rates shall be published annually by the Water Department and provided to the City Council at the first meeting in July of each year.

A.
Pursuant to Section 644.052, RSMo., persons with a direct or indirect sewer service connection to the City public sewer system shall pay an annual fee per water service connection as provided in this Section. Customers served by multiple water service connections shall pay such fee for each water service connection, except that no single facility served by multiple connections shall pay more than a total of seven hundred dollars ($700.00) per year. The sewer service connection fee shall be collected annually. The fee shall be billed and collected in August of each year commencing in August of the year 2001 and shall be collected in the same manner as provided in Section 700.030 for the collection of all other water and sewer charges. All late penalties, disconnection provisions and reconnection charges shall apply to the sewer service connection fee imposed by Section 644.052, RSMo.
B.
The
annual sewer service connection fee shall be as follows:
1.
Seventy cents ($.70) per residential customer.
2.
Three dollars ($3.00) per water service connection for all other
customers with water service connections of less than or equal to
one (1) inch excluding taps used solely for fire suppression and irrigation
systems.
3.
Ten dollars ($10.00) per water service connection for all other customers
with water service connections of more than one (1) inch but less
than or equal to four (4) inches, excluding taps used solely for fire
suppression and irrigation systems.
4.
Twenty-five dollars ($25.00) dollars per water service connection
for all other customers with water service connections of more than
four (4) inches, excluding taps used solely for fire suppression and
irrigation systems.
C.
The
fees imposed by Section 644.052, RSMo., the collection of which is
provided for hereby, shall expire on December 31, 2007, or upon such
later date as the General Assembly of the State of Missouri may from
time to time extend such fees imposed by Chapter 644.052, RSMo.
D.
The
fees collected hereby are State of Missouri fees and shall be remitted
to the State of Missouri as provided by law. Five percent (5%) (or
such other percentage or amount as the General Assembly of the State
of Missouri may from time to time establish) of the fee revenue collected
shall be retained by the City as reimbursement of billing and collection
expenses.

That all authority to make adjustments to water bills due to
large leaks involving extenuating circumstances shall be vested in
the Water and Sewer Committee of the City Council.
