Town of Haverstraw, NY Chapter 142 Solid Waste Disposal

§ 142-1 Definitions.

Terms contained in this chapter shall have the same meaning as is set forth in New York Public Authorities Law Article 8, Title 13-M, unless not defined, in which case such terms shall have their common meaning.

§ 142-2 Transporting solid waste to certain facilities.

The transporting of solid waste from outside the Town of Haverstraw to any location within the Town of Haverstraw, other than the existing Rockland County Solid Waste Transfer Station located at 200 Beach Road, West Haverstraw, New York, for the purpose of depositing, processing, sorting and/or distribution of such solid waste shall be strictly prohibited.

§ 142-3 Penalties for offenses.

Any violation of this chapter shall be a misdemeanor subjecting the offender, for the first offense, to a fine of no less than $250 and/or up to 15 days' imprisonment for each and every day that such violation continues. For the second and each successive offense, the offender shall be subject to a fine of no less than $500 and/or imprisonment for up to 30 days for each and every day that such violation continues. In addition to the foregoing, the Town shall have the authority to seek injunctive and other appropriate relief, including civil penalties, by action in the State Supreme Court to prevent continued and/or future violations of this chapter.
