There is hereby created a board of the City to be known as the "Personnel Advisory Board." The board shall consist of three members. One member shall be appointed by the Mayor to represent management, one member shall be elected in the manner set out in § 50-52 to represent labor, and the third member shall be ex officio the President of the City Council. The member appointed by the Mayor shall be a citizen of the City and shall have been a resident therein for at least two years immediately preceding the date of appointment. Members shall serve until their successors are chosen and qualified.
The elected member of the Personnel Advisory Board shall be selected for a two-year term in accordance with the following provisions:
A. 
Any employee of the City who receives compensation from the City subject to withholding taxes, except employees of the Community Development Agency (CDA), Comprehensive Employment and Training Act (CETA), Housing Authority, Redevelopment Agency and Office of Economic Development, and any successor agencies to those listed in this subsection, shall be eligible to be nominated and to vote in the election.
B. 
Nomination will be by the submission of a nomination in writing signed by 25 employees. Signatures shall be verified by the City Auditor.
C. 
The election shall be held under the supervision of the City Clerk, who shall report the result of such election in writing to the Mayor, the City Council and the Personnel Advisory Board. The hours and places of voting shall be determined by the City Clerk.
D. 
The nominee who receives a plurality of the votes cast shall be declared elected.
E. 
If the elected member resigns or leaves the employ of the City, a special election to fill the vacancy shall be called within 60 days.
Personnel Advisory Board members shall serve without compensation; however, expenses incurred in the performance of their official duties may be reimbursed, subject to appropriation of funds by the City Council.

The Personnel Advisory Board shall advise the Mayor and the Director of Human Resources on the organization of the Department of Human Resources and on City personnel policies. The board shall be responsible to advise in the development, implementation and monitoring of a system of standardized personnel policies.

Chapter 149, § 185 of the Massachusetts General Laws is incorporated by reference into this section. The City Director of Human Resources shall act as the complaint officer for any employee who believes his/her rights under the law have been violated. The Human Resources Director shall annually provide information to departments on the requirements and protection afforded by this section.
