No person shall temporarily erect or place on any street or sidewalk any staging, stone, lumber, earth, brick or building material, except in conjunction with a permit granted by the City. Said permit or license may be obtained from the Director of Traffic and Parking upon payment of the fee as provided in Chapter A110, Fee Schedule, of the City Code.
No person shall occupy, obstruct or encumber any street, sidewalk or other public place with any trunk, box, barrel, package, article or deposit of any kind so as to interfere with the convenient use thereof by travelers.
No person shall stand with, or near to, two or more persons upon any sidewalk, street or other public place so as to obstruct or inconvenience travel.
No person shall erect or maintain any portico, platform, doorstep or other structure extending into any street, sidewalk or other public place.
No person shall erect any post on any street, sidewalk or other public place except by permission of the City Council.
No person shall construct or maintain any cellar door or passageway into a cellar, basement or excavation of any kind so as to extend into or occupy part of any street, sidewalk or other public place, unless the door or passageway is kept covered with a suitable and substantial plank covering or grate, level with the street where it extends into it.
No awnings, shades or signs extending over the sidewalk shall be placed or maintained for any house, shop or store in any street, unless the lowest part thereof shall be at least eight feet above the sidewalk, and unless it is so placed as not to interfere with the convenience of travelers.

A. 
Required; fee; revocation. No person shall place or maintain any structure, as described in M.G.L. c. 85, § 8, projecting into or placed on or over a public way without first obtaining a permit from the City Council. The fee for the permit shall be as provided in Chapter A110, Fee Schedule of the City Code.
B. 
Exception; outdoor dining. A permit issued by the City Council pursuant to this section shall not be required for structures used for outdoor dining on a public sidewalk or other public way, provided the restaurant/applicant has obtained all city required approvals including, but not limited to, written approval from the City Building Inspector.
C. 
Violations; penalty. The City may immediately remove, at the expense of the owner, any sign or structure found to be in violation of this section. Additionally, any person found to be in violation of this section shall also be subject to a fine, as provided in § 2-1025. However, pursuant to M.G.L. c. 85 § 8, no fine shall issue unless the person fails to remove the structure or cure the violation after being given five days' notice to do so.
D. 
Licensing period. A permit issued under the provisions of this article is revocable and shall be valid for the period of time allowed by the permitting authority.
