The Harbormaster shall be within the Police Department, and the Chief of Police shall exercise administrative control, supervision and direction of the Harbormaster.

No person shall operate any motorboat/vessel in Mt. Hope Bay, in the area westerly by the Fall River/Somerset boundary line, northerly by a line between buoy C"17" and the southwest corner of the Fall River City Pier, easterly by the Fall River shoreline, and southerly by the southerly boundary of Kennedy Park as extended into Mt. Hope Bay, at a speed in excess of five miles per hour. This restriction shall not apply to any vessel over 65 feet in length or those engaged in emergency operations. Notice of this speed restriction shall be posted and enforced by the Harbormaster and Assistant Harbormasters. Any violation of the provisions of this section shall be subject to a specific penalty as set forth in Chapter 2, Article X, Noncriminal Disposition of Ordinance Violations, of the City Code.

A. 
No vessel, mooring or other object shall be abandoned, sunk or placed where it may constitute a hazard to navigation or where it is within an area of the waters of Fall River the Harbormaster has restricted to prohibit moorings or tie-ups.
B. 
Any vessel, mooring or object constituting a hazard to navigation, and any vessel or object improperly secured, swamped, sunk, washed ashore or found in a restricted area, may be removed or relocated at the direction of the Harbormaster or an Assistant Harbormaster if corrective action is not taken after 72 hours' written notice to the owner or, if the owner is unknown, after notice has been posted for the same period at the town office or near such vessel, mooring or object.
C. 
The expense of such removal or relocation and liability incurred therefor shall be the responsibility of the owner.
D. 
Nothing in the above subsections shall restrict earlier action by the Harbormaster or an Assistant Harbormaster, with or without notifying the owner, if, in his judgment, such action is necessary to protect life or property.
