In accordance with purposes and preambles set forth herein, the following farming activities shall be deemed established as acceptable, recognized and entitled to encouragement and protection as the collective embodiment of the right-to-farm, subject in all cases, however, to any supervening applicable federal, state or county laws or regulations respecting the public health, safety or otherwise:

Facilities, including but not limited to produce stands and off-street parking areas for seasonal sales operations such as u-pick it marketing and sales, and agricultural educational functions shall be entitled to secure a zoning permit in lieu of formal site plan approval. Off-street parking may be provided on existing fields or driveways without the need to improve said areas to the standards contained in § 550-56 of this chapter. No zoning permit shall be issued where there is a question regarding the public's health, safety or welfare. Where there is cause for such concern, the Director of Planning shall submit the matter to the Planning Board to determine if formal site plan approval is necessary. Reports from the Township's Health Officer, Construction Official and the Police Department's Traffic Safety Bureau may be requested as part of said review.
