A. 
Violations. A person who violates any provision of or fails to perform any duty imposed by this chapter, or who violates any provision of or fails to perform any duty imposed by a rule, regulation, order or permit adopted or issued under this chapter, shall be deemed to have committed a civil infraction and, upon a citation issued pursuant to the provisions of the Public Local Laws of Caroline County, Maryland, entitled "Civil Infractions" shall pay to the court a civil fine.
B. 
Separate infractions. Beginning with the day a citation is issued, each separate day of violation shall constitute a separate and distinct civil infraction, and each such infraction shall be subject to a separate and distinct citation and fine. A repeated violation shall be a separate condition, event or occurrence and not merely the continuation of an existing violation.
C. 
Enforcement procedures. The County shall give consideration to the following when utilizing enforcement procedures:
(1) 
The willfulness of the violation, the extent to which the existence of the violation was known to but uncorrected by the violator and the extent to which the violator exercised reasonable care.
(2) 
The nature and degree of any actual damage to the roads and rights-of-way of the County and the cost of repair of any such damage.
(3) 
The extent to which the nature, degree and location of a violation created a threat to public safety and an interference with public convenience.
(4) 
The extent to which a current violation is part of a recurrent pattern of the same or similar type of violation committed by the same violator.
D. 
Additional right to legal recourse. In addition to the procedures provided in this Article, any person aggrieved by any action taken by the County under this Article shall have all rights to legal recourse available at law and in equity.
E. 
Enforcement procedures nonexclusive. No enforcement procedure under this Article shall be considered exclusive. The County shall be entitled to utilize any lawful means to enforce any provision of this Article.
