The discharge of any draining device onto public roads, rights-of-way
or other public property, except under emergency situations, which
causes a safety hazard to pedestrians or motorists due to flooding
or to the accumulation of ice upon the aforesaid public roads, rights-of-way
and other public property is prohibited.

The owner, tenant, lessee or occupant of any premises in violation
of this article shall be given written notice of said violation by
the Director of Public Works and/or Zoning Officer. Thereafter, said
owner, tenant, lessee or occupant shall be allowed 10 days to abate
the violation complained of. After said ten-day period, the Director
of Public Works and/or Zoning Officer shall make a reinspection of
the premises to determine whether the violation has been abated.
This article shall be prospective in nature, and any persons
to whom this article shall apply shall have until July 1, 1983, to
comply.

Any person, firm or corporation who violates any provision of
this article shall, upon conviction thereof, be punishable by one
or more of the following: by imprisonment for a term not exceeding
90 days or by a fine not exceeding $1,000 or by a period of community
service not exceeding 90 days.
